Harassment will happen at my startup and yours: Here’s how we prepare

Sexual harassment is, unfortunately, always in the news. Of late, it’s revelations at gaming giants and governments. Yet despite how prevalent harassment is, companies often adopt an “it can’t happen here” stance — until it does, and then there are knee-jerk reactions and crisis communications.

A better approach: recognizing how pervasive it is and planning with that in mind.

When I first started Ethena, I explained the concept of innovative harassment prevention training to my father. Like any good parent, he thought my entrepreneurial genius was actually a terrible idea and advised me to stay put at my job. But when he finally accepted that I was going to start this company, he said, “Make sure you don’t have harassment at your company. That would be bad.”

He’s not wrong. My team provides a modern compliance training platform. Since our first product was harassment prevention training, it would be pretty bad if we were talking the talk without walking the walk.

Train your team members to better understand inclusion and recognize what harassment looks like so the bar is set higher than “let’s just not get sued.”

If I could prevent workplace harassment on optimism alone, I absolutely would. But I’ve seen the data on the prevalence of workplace harassment.

A 2018 Pew survey, for example, found that 59% of women and 27% of men reported experiencing sexual harassment. And the rise of remote work hasn’t changed things. In fact, there are some indications that harassment is on the rise thanks to “keyboard courage.”

Knowing that, I’ve come to terms with the fact that these are issues we’ll likely face, so I want us to be prepared. Today’s workplace demands that leaders acknowledge gray areas and engage with uncomfortable topics; it’s how companies grow in new and healthy directions. Here’s how we think about that growth.

Plan for it

As a Floridian, I grew up assuming hurricanes would hit my house. We always had some plywood and canned food because when you know something is going to happen, you plan for it.

Unlike prepared Floridians, startups tend to adopt an ostrich approach when it comes to harassment. Instead of stocking the pantry, so to speak, companies wait until they’re already in a storm.

Early on, a startup is a small group of (usually homogeneous) friends, and it’s uncomfortable to acknowledge that bad things could happen. It’s much easier to hope that building a team of stellar humans is enough.

But, unfortunately, bad things do happen, because sometimes harassment is not as cut-and-dried as we are led to believe. Rather, harassment often grows from the complexities of human interactions — intent, perception, privilege and context, to name a few. It can start with a few small jokes, a colleague who gets drunkenly inappropriate every Friday, or a team that never seems to hire anyone outside of their social circle.

Then, things can escalate, and people start to realize that what they’re actually experiencing is a hostile work environment. Unfortunately, at that point, it’s really hard to right the ship because the company is suddenly 600 people and change gets harder as companies grow.

Knowing that problems are more likely as companies scale, it’s vital that teams prepare by learning how to identify warning signs early. At a bare minimum, train your team members to recognize what workplace harassment looks like and better understand inclusion so that the bar is set higher than “let’s just not get sued.”

Out of everyone at the company, managers really need to get the memo. As a company scales, senior leaders have a limited span of control, so frontline managers become the most crucial employees in either promoting or preventing inclusive workplaces. It just so happens that training is legally required in states like California and New York.

Make feedback, not just “tell HR,” an option

The traditional way that harassment is talked about is very binary. Either a workplace is perfectly inclusive or it’s a toxic cesspool. Obviously, it’s important to take these issues seriously, but the problem with treating every act as either fine or serious, capital-H harassment is that it gives employees a choice between bad and worse.

Let’s say Elena is on an engineering pod with Jonah, and Jonah occasionally does small things that cause her to feel less than included.

For example, they’re hiring for a new front-end engineer and Jonah always refers to this future hire as “he.” In the traditional, frowny-faced lawyer version of harassment, Elena has two options:

  1. Do nothing: Bad because Jonah is going to keep doing it.
  2. Tell HR: Also bad. Elena doesn’t want to get Jonah fired. She just wants him to be more inclusive.

However, if training teaches Elena — and, ideally, everyone else on her team — to say something in the moment, Elena now has a tool she can actually use.

Next time Jonah says, “OK so when he joins … ” Elena can jump in with, “Unless you’re psychic, which seems unlikely given how poorly you did in Fantasy Football, please use ‘they’ to refer to our new hire, since we don’t know their gender.”

Did Elena need to insert the burn? Probably not, but humor can diffuse a tense situation so sure, why not? Regardless, once Elena says something, it’s on Jonah to accept her feedback and make a change; and, if team values are clear, hopefully Jonah’s colleagues will hold Jonah accountable, too.

Accountability is everything

This last lesson is only applicable after something at the company happens. Let’s say Jonah’s comments escalate, even after Elena gives feedback. Jonah consistently excludes Elena and other women from key meetings, talks over them, and when confronted, says, “Look, we all know they’re only here for diversity stats.”

If Jonah’s manager at this fictitious, problematic company does nothing, that’s the ballgame. There’s literally no amount of workshops, training, blog posts or all-hands meetings that can convince Elena that the company cares. Actions speak loudest.

The best possible version of dealing with an issue involves transparency so that people can learn from what happened and see that the company does care. Obviously, it’s hard when issues involve private information and protecting those who reported the issues, but to the extent possible, it’s crucial to have accountability.

Of course, my dad is right: Harassment at my company would be bad. But we’re preparing for it because scaling a company means rapidly increasing the number of human interactions.

Thankfully, building an inclusive company looks a lot like building a good company — preparation, feedback and accountability are managerial best practices that should be put in place early.

Activision Blizzard workers will stage a walkout after ‘abhorrent’ response to harassment suit

One of the world’s biggest video game companies is reeling after a state discrimination and sexual harassment suit kicked off a firestorm of controversy within the company. California’s Department of Fair Employment and Housing sued Activision Blizzard last week, alleging that the company fostered a “breeding ground for harassment and discrimination against women.”

Following a combative response to the lawsuit from corporate leadership, a group of employees at Blizzard will stage a walkout, which is planned for Wednesday at 10 a.m. PDT. Most employees at Blizzard continue to work remotely, but walkout participants will gather tomorrow at the gates to the company’s Irvine campus.

“Given last week’s statements from Activision Blizzard, Inc. and their legal counsel regarding the DFEH lawsuit, as well as the subsequent internal statement from Frances Townsend, and the many stories shared by current and former employees of Activision Blizzard since, we believe that our values as employees are not being accurately reflected in the words and actions of our leadership,” the organizers wrote.

In the new statement, they called for supporters to donate to organizations including Black Girls Code, the anti-sexual-violence organization RAINN and Girls Who Code.

Activision Blizzard publishes some of the biggest titles in gaming, including the Call of Duty franchise, World of Warcraft, Starcraft and Overwatch. Blizzard came under Activision’s wing through a 2008 merger and the subsidiary operates out of its own Irvine, California headquarters.

In the suit, the state agency describes a “frat house” atmosphere in which women are not only not afforded the same opportunities as their male counterparts, but are routinely and openly harassed, sometimes by their superiors.

The company pushed back last week in a fiery statement, blaming “unaccountable state bureaucrats that are driving many of the state’s best businesses out of California” for pursuing the lawsuit. Activision Blizzard Executive Vice President Frances Townsend, former Homeland Security adviser to George W. Bush, echoed that aggressive messaging in an internal memo, slamming the lawsuit as a “distorted and untrue picture of our company.”

In an open letter published Monday, the walkout’s organizers condemned Blizzard’s response to the lawsuit’s allegations. “We believe these statements have damaged our ongoing quest for equality inside and outside of our industry,” they wrote. “ … These statements make it clear that our leadership is not putting our values first.”

More than 2,600 employees signed the letter, which demands an end to mandatory arbitration clauses that “protect abusers and limit the ability of victims to seek restitution,” improved representation and opportunities for women and nonbinary employees, salary transparency and a full audit of diversity, equity and inclusion at the company.

On Twitter, streamers, gamers, game devs and former employees expressed support for Wednesday’s walkout under the hashtag #ActiBlizzWalkout, with some calling for a blackout on Activision Blizzard games as a show of solidarity. Others called for streamers to use the walkout time slot to raise awareness about rampant sexual harassment and discrimination in gaming culture at large.

One Blizzard employee shared a photo of the company’s iconic statue depicting an axe-wielding orc, a central feature of its Irvine headquarters. Three plaques displaying corporate values that surround the statue had been covered with paper: “Lead responsibly,” “play nice, play fair,” and “every voice matters.”

AllVoices raises $3 million to build a platform for anonymous harassment and bias reporting

As the national conversation pushes companies to reexamine the HR processes suppressing sexual harassment and bias reporting, tech startups are looking to find a way to smooth out the process and encourage communication.

LA-based AllVoices is building an encrypted communications platform for offices that allows employees to anonymously send complaints to their human resources department that can then follow-up and track the cases in an easy-to-use dashboard. CEO Claire Schmidt tells TechCrunch that her company has just closed a $3 million seed round with funding from Crosscut, Greycroft, Halogen Ventures, Vitalize VC and others.

Schmidt, most recently a VP at 20th Century Fox, started AllVoices after finding inspiration in Susan Fowler’s Uber blog post to create a platform that allowed employees at companies to anonymously offer feedback and file reports about internal toxicity. Schmidt says existing processes used for reporting can leave victims of harassment hesitant to come forward and fearful of the risk of damaging their career paths.

“We’re using this really outdated process, we’re basically telling people, ‘Okay, just come in and tell someone in HR, and hope for the best,’ ” Schmidt told TechCrunch in an interview. “And to me that seemed especially unfair to the most vulnerable people in any given work environment because they’re junior, they don’t have as much job security — they’re viewed as more expendable.”

Employees at companies that use AllVoices can log into a mobile app and anonymously submit reports and receive text notifications when they’ve gotten a response from the company, a streamlined process that Schmidt hopes can encourage people to “report in real time.” HR people don’t see names or any other identifying information and AllVoices doesn’t know the name of the employee either, with all communications being encrypted.

“We do encrypt all of our data in storage, in backup, in transit, at rest — at every level,” Schmidt says.

Sixty days after a complaint is made, AllVoices sends a notification to the employee asking whether they were aware of any action being taken by the company and how satisfied they were with it. The startup then aggregates that data and provides it back to the company so they can get a clearer sense of their own responsiveness.

AllVoices isn’t the only startup tackling this issue; in 2018 we profiled Spot, which is also building an anonymous reporting platform. AllVoices’ platform goes beyond streamlining processes for sexual harassment; the startup has modules for general feedback, ethics and compliance issues, culture problems, diversity and inclusion concerns and harassment and bias complaints.

The startup has also aimed to make a free version of its product so that employees at companies that haven’t integrated AllVoices can still make anonymous complaints by entering in an email for someone in their HR department. Schmidt hopes that the free service will serve their broader mission and help them onboard new customers.

AllVoices says they now have nearly 50 companies using the platform, including Instacart, GoPro, Wieden+Kennedy, The Wing and FabFitFun.

UK law review eyes abusive trends like deepfaked porn and cyber flashing

The UK government has announced the next phase of a review of the law around the making and sharing of non-consensual intimate images, with ministers saying they want to ensure it keeps pace with evolving digital tech trends.

The review is being initiated in response to concerns that abusive and offensive communications are on the rise, as a result of it becoming easier to create and distribute sexual images of people online without their permission.

Among the issues the Law Commission will consider are so-called ‘revenge porn’, where intimate images of a person are shared without their consent; deepfaked porn, which refers to superimposing a real photograph of a person’s face onto a pornographic image or video without their consent; and cyber flashing, the unpleasant practice of sending unsolicited sexual images to a person’s phone by exploiting technologies such as Bluetooth that allow for proximity-based file sharing.

On the latter practice, the screengrab below is of one of two unsolicited messages I received as pop-ups on my phone in the space of a few seconds while waiting at a UK airport gate — and before I’d had a chance to locate the iOS master setting that actually nixes Bluetooth.

On iOS, even without accepting the AirDrop the cyberflasher is still able to send an unsolicited placeholder image with their request.

Safe to say, this example is at the tamer end of what tends to be involved. More often it’s actual dick pics fired at people’s phones, not a parrot-friendly silicone substitute…

A patchwork of UK laws already covers at least some of the offensive and abusive communications in question, such as the offence of voyeurism under the Sexual Offences Act 2003, which criminalises certain non-consensual photography taken for sexual gratification — and carries a two-year maximum prison sentence (with the possibility that a perpetrator may be required to be listed on the sexual offender register); while revenge porn was made a criminal offence under section 33 of the Criminal Justice and Courts Act 2015.

But the government says that while it feels the law in this area is “robust”, it is keen not to be seen as complacent — hence continuing to keep it under review.

It will also hold a public consultation to help assess whether changes in the law are required.

The Law Commission published Phase 1 of their review of Abusive and Offensive Online Communications on November 1 last year — a scoping report setting out the current criminal law which applies.

The second phase, announced today, will consider the non-consensual taking and sharing of intimate images specifically — and look at possible recommendations for reform. Though it will not report for two years so any changes to the law are likely to take several years to make it onto the statute books.

Among specific issues the Law Commission will consider is whether anonymity should automatically be granted to victims of revenge porn.

Commenting in a statement, justice minister Paul Maynard said: “No one should have to suffer the immense distress of having intimate images taken or shared without consent. We are acting to make sure our laws keep pace with emerging technology and trends in these disturbing and humiliating crimes.”

Maynard added that the review builds on recent changes to toughen UK laws around revenge porn and to outlaw ‘upskirting’ in English law; aka the degrading practice of taking intimate photographs of others without consent.

“Too many young people are falling victim to co-ordinated abuse online or the trauma of having their private sexual images shared. That’s not the online world I want our children to grow up in,” added the secretary of state for digital issues, Jeremy Wright, in another supporting statement.

“We’ve already set out world-leading plans to put a new duty of care on online platforms towards their users, overseen by an independent regulator with teeth. This Review will ensure that the current law is fit for purpose as we deliver our commitment to make the UK the safest place to be online.”

The Law Commission review will begin on July 1, 2019 and report back to the government in summer 2021.

Terms of Reference will be published on the Law Commission’s website in due course.

The UK now has a law against upskirting

A law change that comes into force in the UK today makes the highly intrusive practice of ‘upskirting’ illegal.

The government said it wants the new law to send a clear message that such behaviour is criminal and will not be tolerated.

Perpetrators in England and Wales face up to two years in prison under the new law if they’re convicted of taking a photograph or video underneath a person’s clothes for the purpose of viewing their underwear or genitals/buttocks without their knowledge or consent for sexual gratification or to cause humiliation, distress or alarm. (Scotland, home of the traditional male clothing item known as the kilt, has had a law against upskirting since 2010.)

There have been prosecutions for upskirting in England and Wales under an existing common law offence of outraging public decency. But following a campaign started by an upskirting victim the government decided to legislate to plug gaps in the law to make it a sexual offence.

The Voyeurism (Offences) (No. 2) Bill was introduced on June 21 last year and gains royal assent today.

Where the offence of upskirting is committed in order to obtain sexual gratification it can result in the most serious offenders being placed on the sex offenders register.

Under the new law victims are also entitled to automatic protection, such as from being identified in the media.

While the UK government is intending the law change to send a clear message that upskirting is socially unacceptable, there’s no doubt that legislation alone can’t do that. Robust enforcement is essential to counter any problematic attitudes that might be contributing to encourage antisocial uses of technologies in the first place.

For example, in South Korea a law against upskirting carries a maximum sentence of five years in prison yet the legislation has failed to curb an epidemic of offences fuelled by cheap access to tiny hidden spy cameras and baked in societal sexism — the latter seemingly also influencing how police choose to uphold the law, with campaigners complaining most perpetrators get off with small fines.

Y Combinator survey confirms what we already know — female founders are too often victims of sexual harassment

Y Combinator has released the results of a survey, completed in partnership with its portfolio company Callisto, highlighting the pervasive role of sexual harassment in venture capital and technology startups.

Callisto, a sexual misconduct reporting software built for victims, is a graduate of YC’s winter 2018 class. The company sent a survey to 125 of YC’s 384 female founders, asking if they had been “assaulted or coerced by an angel or VC investor in their startup career.”

Eighty-eight female founders completed the survey; 19 in total claimed to have experienced some form of harassment.

More specifically, 18 said that inappropriate experience consisted of “unwanted sexual overtures;” 15 said it was “sexual coercion;” four said it was “unwanted sexual contact.”

As part of the release of the survey findings, YC announced they’ve established a formal process for their founders to report harassment and assault within Bookface, the startup accelerator’s private digital portal for its founders.

“You can report at any time, even years after the incident took place,” YC wrote in the blog post. “The report will remain confidential. We encourage other investors to set up similar reporting systems.”

First Round Capital is another investor to recently poll its founders on issues of sexual misconduct. Similarly, the early-stage investor found that half of the 869 founders polled were harassed or knew a victim of workplace harassment.

As for Callisto, the 7-year-old non-profit said it will launch Callisto for founders, a new tool that will support victims. Using Callisto, founders can record the identities of perpetrators in the tech and VC industry. The company will collect the information and refer victims to a lawyer who will provide free advice and the option to share their information with other victims of the same perpetrator. From there, victims can decide if they want to go public together with their accusations.

Tech’s widespread sexual harassment problem is not new, but more women and victims of harassment have come forward in recent years as the #MeToo movement encourages them to name their harassers. Justin Caldbeck, formerly of Binary Capital, and former SoFi chief executive officer Mike Cagney are among the Silicon Valley elite to be ousted amid allegations of sexual misconduct in the #MeToo era.

Tall Poppy aims to make online harassment protection an employee benefit

For the nearly 20 percent of Americans who experience severe online harassment, there’s a new company launching in the latest batch of Y Combinator called Tall Poppy that’s giving them the tools to fight back.

Co-founded by Leigh Honeywell and Logan Dean, Tall Poppy grew out of the work that Honeywell, a security specialist, had been doing to hunt down trolls in online communities since at least 2008.

That was the year that Honeywell first went after a particularly noxious specimen who spent his time sending death threats to women in various Linux communities. Honeywell cooperated with law enforcement to try and track down the troll and eventually pushed the commenter into hiding after he was visited by investigators.

That early success led Honeywell to assume a not-so-secret identity as a security expert by day for companies like Microsoft, Salesforce, and Slack, and a defender against online harassment when she wasn’t at work.

“It was an accidental thing that I got into this work,” says Honeywell. “It’s sort of an occupational hazard of being an internet feminist.”

Honeywell started working one-on-one with victims of online harassment that would be referred to her directly.

“As people were coming forward with #metoo… I was working with a number of high profile folks to essentially batten down the hatches,” says Honeywell. “It’s been satisfying work helping people get back a sense of safety when they feel like they have lost it.”

As those referrals began to climb (eventually numbering in the low hundreds of cases), Honeywell began to think about ways to systematize her approach so it could reach the widest number of people possible.

“The reason we’re doing it that way is to help scale up,” says Honeywell. “As with everything in computer security it’s an arms race… As you learn to combat abuse the abusive people adopt technologies and learn new tactics and ways to get around it.”

Primarily, Tall Poppy will provide an educational toolkit to help people lock down their own presence and do incident response properly, says Honeywell. The company will work with customers to gain an understanding of how to protect themselves, but also to be aware of the laws in each state that they can use to protect themselves and punish their attackers.

The scope of the problem

Based on research conducted by the Pew Foundation, there are millions of people in the U.S. alone, who could benefit from the type of service that Tall Poppy aims to provide.

According to a 2017 study, “nearly one-in-five Americans (18%) have been subjected to particularly severe forms of harassment online, such as physical threats, harassment over a sustained period, sexual harassment or stalking.”

The women and minorities that bear the brunt of these assaults (and, let’s be clear, it is primarily women and minorities who bear the brunt of these assaults), face very real consequences from these virtual assaults.

Take the case of the New York principal who lost her job when an ex-boyfriend sent stolen photographs of her to the New York Post and her boss. In a powerful piece for Jezebel she wrote about the consequences of her harassment.

As a result, city investigators escorted me out of my school pending an investigation. The subsequent investigation quickly showed that I was set up by my abuser. Still, Mayor Bill de Blasio’s administration demoted me from principal to teacher, slashed my pay in half, and sent me to a rubber room, the DOE’s notorious reassignment centers where hundreds of unwanted employees languish until they are fired or forgotten.

In 2016, I took a yearlong medical leave from the DOE to treat extreme post-traumatic stress and anxiety. Since the leave was almost entirely unpaid, I took loans against my pension to get by. I ran out of money in early 2017 and reported back to the department, where I was quickly sent to an administrative trial. There the city tried to terminate me. I was charged with eight counts of misconduct despite the conclusion by all parties that my ex-partner uploaded the photos to the computer and that there was no evidence to back up his salacious story. I was accused of bringing “widespread negative publicity, ridicule and notoriety” to the school system, as well as “failing to safeguard a Department of Education computer” from my abusive ex.

Her story isn’t unique. Victims of online harassment regularly face serious consequences from online harassment.

According to a  2013 Science Daily study, cyber stalking victims routinely need to take time off from work, or change or quit their job or school. And the stalking costs the victims $1200 on average to even attempt to address the harassment, the study said.

“It’s this widespread problem and the platforms have in many ways have dropped the ball on this,” Honeywell says.

As Honeywell heard more and more stories of online intimidation and assault, she started laying the groundwork for the service that would eventually become Tall Poppy. Through a mutual friend she reached out to Dean, a talented coder who had been working at Ticketfly before its Eventbrite acquisition and was looking for a new opportunity.

That was in early 2015. But, afraid that striking out on her own would affect her citizenship status (Honeywell is Canadian), she and Dean waited before making the move to finally start the company.

What ultimately convinced them was the election of Donald Trump.

“After the election I had a heart-to-heart with myself… And I decided that I could move back to Canada, but I wanted to stay and fight,” Honeywell says.

Initially, Honeywell took on a year-long fellowship with the American Civil Liberties Union to pick up on work around privacy and security that had been handled by Chris Soghoian who had left to take a position with Senator Ron Wyden’s office.

But the idea for Tall Poppy remained, and once Honeywell received her green card, she was “chomping at the bit to start this company.”

A few months in the company already has businesses that have signed up for the services and tools it provides to help companies protect their employees.

Some platforms have taken small steps against online harassment. Facebook, for instance, launched an initiative to get people to upload their nude pictures  so that the social network can monitor when similar images are distributed online and contact a user to see if the distribution is consensual.

Meanwhile, Twitter has made a series of changes to its algorithm to combat online abuse.

“People were shocked and horrified that people were trying this,” Honeywell says. “[But] what is the way [harassers] can do the most damage? Sharing them to Facebook is one of the ways where they can do the most damage. It was a worthwhile experiment.”

To underscore how pervasive a problem online harassment is, out of the four companies where the company is doing business or could do business in the first month and a half there is already an issue that the company is addressing. 

“It is an important problem to work on,” says Honeywell. “My recurring realization is that the cavalry is not coming.”
