Breach simulation startup AttackIQ raises $44M to fuel expansion

AttackIQ, a cybersecurity startup that provides organizations with breach and attack simulation solutions, has raised $44 million in Series C funding as it looks to ramp up its international expansion.

The funding round was led by Atlantic Bridge, Saudi Aramco Energy Ventures (SAEV) and Gaingels, with existing vendors — including Index Ventures, Khosla Ventures, Salesforce Ventures and Telstra Ventures — also participating. The round brings the company’s total funding raised to date to $79 million. 

AttackIQ was founded in 2013 and is based out of San Diego, California. It provides an automated validation platform that runs scenarios to detect any gaps in a company’s defenses, enabling organizations to test and measure the effectiveness of their security posture and receive guidance on how to fix what’s broken. Broadly, AttackIQ’s platform helps an organization’s security teams anticipate, prepare and hunt for threats that may impact their business, before hackers get there first.

Its Security Optimization Platform platform, which supports Windows, Linux and macOS across public, private and on-premises cloud environments, is based on the MITRE ATT&CK framework, a curated knowledge base of known adversary threats, tactics and techniques. This is used by a number of cybersecurity companies also building continuous validation services, including FireEye, Palo Alto Networks and Cymulate.

AttackIQ says this latest round of funding, which comes more than two years after its last, arrives at a “dynamic time” for the company. Not only has cybersecurity become more of a priority for organizations as a result of a major uptick in both ransomware and supply-chain attacks, the company also recently accelerated its international expansion efforts through a partnership with technology distributor Westcon.

The startup says it’s planning to use these new funds to further expand internationally through its newfound partnership with Atlantic Bridge, which will also see Kevin Dillon, the company’s co-founder and managing director, join the AttackIQ board of directors. 

“AttackIQ has established itself as a category leader with a formidable enterprise customer base that includes four of the Fortune 20,” said Dillon. “We believe deeply in the company’s vision and potential to become the next billion-dollar cybersecurity software company and look forward to helping the company turn early traction in Europe and the Middle East into robust, long-term expansion.”

Brett Galloway, CEO of AttackIQ, said the round “reaffirms the strength” of its platform.

As well as enabling organizations to review the robustness of their security defenses, the startup also runs the AttackIQ Academy, which provides free entry-level and advanced cybersecurity training. It has accumulated 17,200 registered students to date across 176 countries.

After 200% ARR growth in 2020, CourseKey raises $9M to digitize trade schools

When the COVID-19 pandemic hit and forced educational institutions to go virtual, many were scrambling to develop online or blended curriculums.

That struggle was particularly challenging for trade schools, many of which were not designed to teach online and were mostly paper-driven. 

CourseKey, a San Diego-based trade school management SaaS startup, was in a unique position. Demand surged and its ARR grew by 200% in 2020. And now, the company has raised $9 million in a Series B led by SignalFire, with participation from existing backer Builders VC to help it continue its momentum. 

Founded in 2015 by Luke Sophinos and Fadee Kannah, CourseKey’s B2B platform is designed to work with organizations that teach some of our most essential workers — from automotive mechanics to electricians to plumbers to nurses, phlebotomists and dental assistants.

The goal is to help those organizations boost revenue by improving student retention and graduation rates, helping them maintain regulatory compliance and generally streamline processes. 

“Things really took off last year when the coronavirus hit,” Sophinos said. “So many schools had to adopt a digital arsenal. We saw a massive acceleration trend that was already going to happen. Every industry had been eaten. We just found a space that wasn’t yet.”

CourseKey currently works with more than 200 career colleges, including the Paul Mitchell School and the Institute for Business & Technology, among others. More than 100,000 students use its software.

For Sophinos and Kannah, founding CourseKey was more than just a business opportunity. Kannah, who had fled Iraq as a refugee, saw family members going through trade schools that were lacking technology infrastructure and modern software tools. He architected the CourseKey platform. 

Sophinos, frustrated by his own college experience, applied for The Thiel Fellowship — a program that supports students in company building instead of university attending. However, he recognized that not everyone who doesn’t want to go to traditional college has that option.

“While looking at alternatives, our early team began recognizing a market that we felt no one was paying attention to. It was occupied by our friends and by our family members,” Sophinos said. “It was a space that, for some odd reason, was largely being left out of the education conversation.”

In 2017, the founding team (Sophinos, Kannah, Ryan Vanshur, Marc Barron, Michael Woo, Fadi George and Luan Nguyen) partnered with a large vocational education provider to build and launch what Sophinos describes as “the world’s first trade school management system.”

“We focused on automating daily classroom procedures like attendance and grading, enhancing the student experience through communication tools, helping to identify at-risk students, and simplifying compliance,” he said. “We also visualized data for retention purposes.”

CourseKey also does things like track skill attainment, run evaluations and exams and integrate third-party tools.

The startup’s goal with its new capital is to scale the platform to serve “every trade school in the country” with the mission of changing the narrative that four-year college is the “only option.” It also plans to add new features and capabilities, largely based on customer requests. CourseKey also plans to nearly double its current headcount of just over 50 employees to nearly 100 over the next two years.

“This is a massive market and massive business opportunity,” Sophinos said.

CourseKey has an impressive list of supporters beyond SignalFire and Builders. Steve Altman, former vice chairman and president of Qualcomm, led its $3.5 million seed round, which also included participation from Larry Rosenberger, former FICO CEO. Dennis Yang, former CEO of edtech giant Udemy, and Altman now serve on its board.

SignalFire Managing Director Wayne Hu, who also took a seat on the startup’s board with the new round, said his firm recognized that vocational schools and their administrators, instructors and students “suffer from a lack of purpose-built software.”

“Student Information Systems and Learning Management Systems are optimized for traditional K-12 schools and university workflow, but vocational schools are stuck relying on pen and paper or trying to shoe-horn in solutions that aren’t built for them,” Hu wrote in a blog post.

CourseKey, in SignalFire’s view, is reimagining a new education operating system built specifically for experiential, hands-on learning models, which continues to evolve with hybrid/distance learning.  

Hu also pointed out that since many of the jobs that vocational schools are preparing people for “have life or death consequences,” they are highly regulated.

“Not only does CourseKey improve trade school business KPIs, it serves as insurance against this existential risk,” he added.

GrubMarket raises $60M as food delivery stays center stage

Companies that have leveraged technology to make the procurement and delivery of food more accessible to more people have been seeing a big surge of business this year, as millions of consumers are encouraged (or outright mandated, due to COVID-19) to socially distance or want to avoid the crowds of physical shopping and eating excursions.

Today, one of the companies that is supplying produce and other items both to consumers and other services that are in turn selling food and groceries to them, is announcing a new round of funding as it gears up to take its next step, an IPO.

GrubMarket, which provides a B2C platform for consumers to order produce and other food and home items for delivery, and a B2B service where it supplies grocery stores, meal-kit companies and other food tech startups with products that they resell, is today announcing that it has raised $60 million in a Series D round of funding.

Sources close to the company confirmed to TechCrunch that GrubMarket — which is profitable, and originally hadn’t planned to raise more than $20 million — has now doubled its valuation compared to its last round — sources tell us it is now between $400 million and $500 million.

The funding is coming from funds and accounts managed by BlackRock, Reimagined Ventures, Trinity Capital Investment, Celtic House Venture Partners, Marubeni Ventures, Sixty Degree Capital and Mojo Partners, alongside previous investors GGV Capital, WI Harper Group, Digital Garage, CentreGold Capital, Scrum Ventures and other unnamed participants. Past investors also included Y Combinator, where GrubMarket was part of the Winter 2015 cohort. For some context, GrubMarket last raised money in April 2019 — $28 million at a $228 million valuation, a source says.

Mike Xu, the founder and CEO, said that the plan remains for the company to go public (he’s talked about it before), but given that it’s not having trouble raising from private markets and is currently growing at 100% over last year, and the IPO market is less certain at the moment, he declined to put an exact timeline on when this might actually happen, although he was clear that this is where his focus is in the near future.

“The only success criteria of my startup career is whether GrubMarket can eventually make $100 billion of annual sales,” he said to me over both email and in a phone conversation. “To achieve this goal, I am willing to stay heads-down and hardworking every day until it is done, and it does not matter whether it will take me 15 years or 50 years.”

I don’t doubt that he means it. I’ll note that we had this call in the middle of the night his time in California, even after I asked multiple times if there wasn’t a more reasonable hour in the daytime for him to talk. (He insisted that he got his best work done at 4:30 a.m., a result of how a lot of the grocery business works.) Xu on the one hand is very gentle with a calm demeanor, but don’t let his quiet manner fool you. He also is focused and relentless in his work ethic.

When people talk today about buying food, alongside traditional grocery stores and other physical food markets, they increasingly talk about grocery delivery companies, restaurant delivery platforms, meal kit services and more that make or provide food to people by way of apps. GrubMarket has built itself as a profitable but quiet giant that underpins the fuel that helps companies in all of these categories by becoming one of the critical companies building bridges between food producers and those that interact with customers.

Its opportunity comes in the form of disruption and a gap in the market. Food production is not unlike shipping and other older, non-tech industries, with a lot of transactions couched in legacy processes: GrubMarket has built software that connects the different segments of the food supply chain in a faster and more efficient way, and then provides the logistics to help it run.

To be sure, it’s an area that would have evolved regardless of the world health situation, but the rise and growth of the coronavirus has definitely “helped” GrubMarket not just by creating more demand for delivered food, but by providing a way for those in the food supply chain to interact with less contact and more tech-fueled efficiency.

Sales of WholesaleWare, as the platform is called, Xu said, have seen more than 800% growth over the last year, now managing “several hundreds of millions of dollars of food wholesale activities” annually.

Underpinning its tech is the sheer size of the operation: economies of scale in action. The company is active in the San Francisco Bay Area, Los Angeles, San Diego, Seattle, Texas, Michigan, Boston and New York (and many places in between) and says that it currently operates some 21 warehouses nationwide. Xu describes GrubMarket as a “major food provider” in the Bay Area and the rest of California, with (as one example) more than 5 million pounds of frozen meat in its east San Francisco Bay warehouse.

Its customers include more than 500 grocery stores, 8,000 restaurants and 2,000 corporate offices, with familiar names like Whole Foods, Kroger, Albertson, Safeway, Sprouts Farmers Market, Raley’s Market, 99 Ranch Market, Blue Apron, Hello Fresh, Fresh Direct, Imperfect Foods, Misfit Market, Sun Basket and GoodEggs all on the list, with GrubMarket supplying them items that they resell directly, or use in creating their own products (like meal kits).

While much of GrubMarket’s growth has been — like a lot of its produce — organic, its profitability has helped it also grow inorganically. It has made some 15 acquisitions in the last two years, including Boston Organics and EJ Food Distributor this year.

It’s not to say that GrubMarket has not had growing pains. The company, Xu said, was like many others in the food delivery business — “overwhelmed” at the start of the pandemic in March and April of this year. “We had to limit our daily delivery volume in some regions, and put new customers on waiting lists.” Even so, the B2C business grew between 300% and 500% depending on the market. Xu said things calmed down by May and even as some B2B customers never came back after cities were locked down, as a category, B2B has largely recovered, he said.

Interestingly, the startup itself has taken a very proactive approach in order to limit its own workers’ and customers’ exposure to COVID-19, doing as much testing as it could — tests have been, as we all know, in very short supply — as well as a lot of social distancing and cleaning operations.

“There have been no mandates about masks, but we supplied them extensively,” he said.

So far it seems to have worked. Xu said the company has only found “a couple of employees” that were positive this year. In one case in April, a case was found not through a test (which it didn’t have, this happened in Michigan) but through a routine check and finding an employee showing symptoms, and its response was swift: the facilities were locked down for two weeks and sanitized, despite this happening in one of the busiest months in the history of the company (and the food supply sector overall).

That’s notable leadership at a time when it feels like a lot of leaders have failed us, which only helps to bolster the company’s strong growth.

Improving the logistics of trucking, San Diego’s Flock Freight raises $50 million

“We want to change the way freight moves,” says Oren Zaslansky, the chief executive and founder of Flock Freight.

His company, which has been operating in stealth mode for the last two years, has finally emerged with a new solution for freight shipping that purports to bring in more money to shippers, remove inefficiencies in the current hub-and-spoke model for freight and offer better deals to shipping customers.

He’s also got $50 million in financing in the bank in what is one of the largest recent investments in a San Diego-based company.

For Zaslansky, the shipping business is a family affair. “My parents grew up in the moving business… I grew up around both entrepreneurship and freight,” he says.

Those twin passions led him to start his own trucking business out of college in the San Diego area. He also launched a brokerage business to support supply chain logistics. The exposure to both is what led Zaslansky to launch Flock Freight and its big new financing round, which closed earlier this week.

The company raised its cash to change the way shippers move small amounts of goods — those less-than-a-truckload-sized amounts that have to move through hub-and-spoke operations which increase the time goods are on the road and the possibility for breakage as they’re unloaded and reloaded onto different delivery vehicles.

“We want to disintermediate the infrastructure of hub and spoke,” says Zaslansky. “We want to carpool. We use our technology to change the way freight moves.”

Zaslansky isn’t talking about very small orders that can be delivered through a service like Roadie — the delivery company that raised $39 million from investors led by Home Depot back in February 2019.

This is still trucking — it’s a carpool in a 70-foot-long tractor trailer. Flock Freight works by reaching out to small and mid-size trucking companies and integrating their orders onto the shipments that these firms are already making. “We go to the carriers that are much more used to working with a third party to fill up empty trucks,” Zaslansky says.  

Right now, that’s about 15% of the $110 billion freight and logistics trucking market, Zaslansky says.

The new investments into Flock Freight came from SignalFire and GLP Capital Partners in mid-February and they were likely drawn to the company’s claims that its service can eliminate damage claims, collect freight from multiple shippers and optimize route delivery for a 40% savings in fuel emissions, and the guaranteed delivery rate of 97.5%. 

Companies like Tuft & Needle and Titan Supply Group are already using the company’s services, according to a statement from Flock Freight.

Flock Freight makes its market by having a window into the spare capacity of trucks and charging shippers for the exact amount of capacity that they’re using. “We want to go to a shipper and say — that [cargo] is 75% of the truck and we’ll charge you 75% of the truck,” said Zaslansky. For carriers, they can say that the price they’ve charged is for 100% of the truck and Flock Freight will add another 10 feet of freight and an additional $1,000 into a carrier’s pocket, Zaslansky said.

San Diego’s Trust & Will raises $6 million for online estate planning

Estate planning in the U.S. is a $180 billion industry and, unlike many of the other areas in the multitrillion-dollar financial services market, it’s one that has yet to see a slew of technology companies come in to try to improve efficiencies.

One notable exception is Trust & Will, the San Diego-based startup that has announced a new $6 million investment to expand sales and marketing, product development and partnerships.

The company joins services like Quicken’s WillMaker and startups like Everplans as relatively new entrants into the technology-enabled estate planning business.

Timing seems good for the company and its other competitors. The $180 billion estate planning business is expected to surge as millennials start having children and begin thinking about their wills. It joins other staid businesses like life insurance and home insurance as a category that’s traditionally been overlooked by entrepreneurs who now see increasingly digital customers make demands of industry participants.

Right now, half of all adults in the U.S. have no will and millions more have out-of-date estate plans, according to Trust & Will. In addition, 45 million parents with minor children have no form of estate plan.

Since its launch in April, Trust & Will has had 60,000 members enroll in the company’s platform; those enrollments represent $15.1 billion in total assets, $2.7 billion in reported life insurance policies, $137 million in charitable commitments and 88% holding real estate assets.

The company has a tiered subscription model offering a $399-$499 service plus an annual subscription fee for the creation of a trust-based estate plan that the company says can avoid probate for the protection and transfer of assets; a $69-$129 level, which includes plans for surviving beneficiaries and asset distribution; and a $39-$49 plan for parents with minor children who aren’t ready to complete a will.

While customers may be able to draft a will themselves and just store it in a safe place, some people will likely gravitate to a digital will. At least, that’s what Link Ventures, Revolution’s Rise of the Rest Seed Fund, Western Technology Investment, Techstars Ventures, Luma Launch and Halogen Ventures are hoping for with their commitment to the company’s Series A financing.

In January, the company closed its first electronic will with help from its industry partner, Notarize. Co-founded by serial entrepreneur Cody Barbo, former product ad marketing strategist Daniel Goldstein and product designer Brian Lamb, the company now counts 11 people on staff.

“Trust & Will is another example of how digital services are disrupting traditional industries by offering a convenient and lower-cost estate planning solution that helps consumers protect their valuable assets and loved ones,” said Rob Chaplinsky, a managing director at Trust & Will’s series A lead investor, Link Ventures. “We have been following this category for quite some time and feel that Trust & Will’s product and rapid market traction are second to none. We look forward to leveraging our big data assets to help them scale.”

Canoo, the electric vehicle startup formed from Faraday Future’s ashes, seeks $200 million

Less than a month after rebranding as Canoo, the startup electric vehicle company formerly known as Evelozcity is on the hunt for $200 million in new capital.

The startup, which is backed by a clutch of private individuals and family offices hailing from China, Germany and Taiwan, is hoping to line up the new capital from some more recognizable names as it finalizes supply deals with vendors, according to a person with knowledge of the company’s plans.

Canoo is locking in final contracts with its vendors and is going to be in production with prototypes before the end of the year. The company, which will make its vehicles available through a subscription-based model, already has 400 employees and just announced new key hires along with its rebranding.

It’s a quick ramp for a company that only two years ago was struggling to extricate itself from the morass that was Faraday Future.

Canoo began life as Evelozcity back in 2017. It was formed after Stefan Krause, a former executive at BMW and Deutsche Bank, and another former BMW executive, Ulrich Kranz, absconded from Faraday Future amid that company’s struggles.

Reportedly, Krause and Kranz left over repeated clashes with Faraday’s founding team of Jia Yueting, the main investor and shareholder, and Chaoying Deng, according to the Verge.

The situation at Evelozcity became so toxic that after the two men left, Jia accused them of “malfeasance and dereliction of duty.”

The company was launched in secret, but news of its existence came to light after Faraday Future filed a lawsuit accusing the new company of the theft of trade secrets.

Now, Canoo is rounding out its executive team and pushing forward with plans to bring prototype vehicles to market by the end of the year.

Olivier Bellin joined the company as its head of operations from STMicroelectronics, a Geneva-based semiconductor company where he served as chief financial officer of the company’s U.S. operations.

Former president of BMW manufacturing Clemens Schmitz-Justen also joined the company as its head of manufacturing — overseeing the contract manufacturing strategy, which will see the company outsource production of vehicles in the U.S. and China.

Canoo said that it intends to use a modular “skateboard” approach to its vehicle design where different form factors can rest atop its chassis. The company touts that its different cabins can be tailored to suit the needs of different customers — ranging from commuter vehicles, public or group transportation, delivery vehicles and private cars.

 

The company is also crafting its user interface and subscription services around its passengers and renters. To that end, Canoo has brought on James Cox, a former Uber executive in charge of product operations for the ride-hailing business’ rider application, who will be developing digital products for the company’s initial customers, according to a March statement.

Initially, Canoo will target customers in Los Angeles and the Bay Area, with additional plans to expand to San Diego and Seattle when the company brings its commercial vehicles to market in 2021.

Canoo plans to use blockchain technology to secure its subscription services and ensure an asset-light approach to development by outsourcing its manufacturing in the U.S. and China, according to one person with knowledge of the company’s plans.

With the development of that subscription model, the car company is taking a page from the playbook other automakers are beginning to toy with. Despite the fact that Cadillac cancelled its Book subscription service late last year, companies like BMW, Volvo and Porsche have all pressed on with their experiments with subscriptions.

As it rolls out its subscription service, Canoo is targeting a lower price point than its competitors for its fully electric and “autonomous-ready” vehicles.

At the end of the day the company believes that there are more than 35 cities around the world that are suitable for its offering.

And now that the lawsuits are over and Faraday Future continues to wobble, it seems that plans for Canoo are gathering steam.

The rebranding effort, and the company’s new name itself, is indicative of its goals.

“We picked Canoo because it sounds distinctive, looks cool and creates a feeling of both relaxation and movement,” said Krause, in a statement. “For thousands of years, a canoe has been a simple, sustainable transportation device used all over the world.”

Edgybees’s new developer platform brings situational awareness to live video feeds

San Diego-based Edgybees today announced the launch of Argus, its API-based developer platform that makes it easy to add augmented reality features to live video feeds.

The service has long used this capability to run its own drone platform for first responders and enterprise customers, which allows its users to tag and track objects and people in emergency situations, for example, to create better situational awareness for first responders.

I first saw a demo of the service a year ago, when the team walked a group of journalists through a simulated emergency, with live drone footage and an overlay of a street map and the location of ambulances and other emergency personnel. It’s clear how these features could be used in other situations as well, given that few companies have the expertise to combine the video footage, GPS data and other information, including geographic information systems, for their own custom projects.

Indeed, that’s what inspired the team to open up its platform. As the Edgybees team told me during an interview at the Ourcrowd Summit last month, it’s impossible for the company to build a new solution for every vertical that could make use of it. So instead of even trying (though it’ll keep refining its existing products), it’s now opening up its platform.

“The potential for augmented reality beyond the entertainment sector is endless, especially as video becomes an essential medium for organizations relying on drone footage or CCTV,” said Adam Kaplan, CEO and co-founder of Edgybees. “As forward-thinking industries look to make sense of all the data at their fingertips, we’re giving developers a way to tailor our offering and set them up for success.”

In the run-up to today’s launch, the company has already worked with organizations like the PGA to use its software to enhance the live coverage of its golf tournaments.

It’s a draw in latest Qualcomm v Apple patent scores

It’s Qualcomm 1, Apple 1 in the latest installment of the pair’s bitter patent bust-up — the litigious IP infringement claim saga that also combines a billion-dollar royalties suit filed by Cupertino alleging that the mobile chipmaker’s licensing terms are unfair.

The iPhone maker filed against Qualcomm on the latter front two years ago and the trial is due to kick off next month. But a U.S. federal court judge issued a bracing sharpener earlier this month, in the form of a preliminary ruling — finding Qualcomm owes Apple nearly $1 billion in patent royalty rebate payments. So that courtroom looks like one to watch for sure.

Yesterday’s incremental, two-fold development in the overarching saga relates to patent charges filed by Qualcomm against Apple back in 2017, via complaints to the U.S. International Trade Commission (ITC) in which it sought to block domestic imports of iPhones.

In an initial determination on one of these patent complaints published yesterday, an ITC administrative law judge found Apple violated one of Qualcomm’s patents — and recommended an import ban.

Though Apple could (and likely will) request a review of that non-binding decision.

Related: A different ITC judge found last year that Apple had violated another Qualcomm patent but did not order a ban on imports — on “public interest” grounds.

ITC staff also previously found no infringement of the very same patent, which likely bolsters the case for a review. (The patent in question, U.S. Patent No. 8,063,674, relates to “multiple supply-voltage power-up/down detectors.”)

Then, later yesterday, the ITC issued a final determination on a second Qualcomm v Apple patent complaint — finding no patent violations on the three claims that remained at issue (namely: U.S. Patent No. 9,535,490; U.S. Patent No. 8,698,558; and U.S. Patent No. 8,633,936), terminating its investigation.

Qualcomm said it intends to appeal.

The mixed bag of developments sit in the relatively “minor battle” category of this slow-motion high-tech global legal war (though, of the two, the ITC’s final decision looks more significant), along with the outcome of a jury trial in San Diego earlier this month, which found in Qualcomm’s favor over some of the same patents the ITC cleared Apple of infringing.

Reuters reports the chipmaker has cited the contradictory outcome of the earlier jury trial as grounds to push for a “reconsideration” of the ITC’s decision.

“The Commission’s decision is inconsistent with the recent unanimous jury verdict finding infringement of the same patent after Apple abandoned its invalidity defense at the end of trial,” Qualcomm said in a statement. “We will seek reconsideration by the Commission in view of the jury verdict.”

Albeit, given the extreme complexities of chipset component patent suits, it’s not really surprising a jury might reach a different outcome to an ITC judge.

In the other corner, Apple issued its now customary punchy response statement to the latest developments, swinging in with: “Qualcomm is using these cases to distract from having to answer for the real issues, their monopolistic business practices.”

Safe to say, the litigious saga continues. And iPhones continue being sold in the U.S.

Other notable (but still only partial) wins for Qualcomm include a court decision in China last year ordering a ban on iPhone sales in the market — which Apple filed an appeal to overturn. So no China iPhone ban yet.

And an injunction ordered by a court in Germany forced Apple to briefly pull certain iPhone models from sale in its own stores in January. By February the models were back on its shelves — albeit now with Qualcomm not Intel chips inside.

But it’s not all been going Qualcomm’s way in Germany. Also in January, another court in the country dismissed a separate patent claim as groundless.

A decision is also still pending in the U.S. Federal Trade Commission’s antitrust case against Qualcomm.

In that suit the chipmaker is accused of operating a monopoly and forcing exclusivity from Apple while charging “excessive” licensing fees for standards-essential patents. The trial wrapped up in January and is pending a verdict.

U.S. federal court jury finds Apple infringed three Qualcomm patents

Mobile chipmaker Qualcomm has chalked up another small legal victory against Apple in another patent litigation suit.

A jury in a U.S. federal court in San Diego found Friday that Apple owes Qualcomm about $31M for infringing three patents, per Reuters.

As we reported earlier the San Diego patent suit relates to the power consumption and speed of boot-up times for iPhones sold between mid-2017 and late-2018.

Qualcomm had asked to be awarded up to $1.41 in unpaid patent royalties damages per infringing iPhone sold during the period.

The chipmaker has filed a number of patent suits against the iPhone maker in the U.S., Europe and Asia in recent years. The suits are skirmishes in a bigger battle between the pair over licensing terms that Apple alleges are unfair and illegal.

In a statement on on the San Diego trial outcome Qualcomm executive vice president and general counsel, Don Rosenberg, said:

Today’s unanimous jury verdict is the latest victory in our worldwide patent litigation directed at holding Apple accountable for using our valuable technologies without paying for them. The technologies invented by Qualcomm and others are what made it possible for Apple to enter the market and become so successful so quickly. The three patents found to be infringed in this case represent just a small fraction of Qualcomm’s valuable portfolio of tens of thousands of patents. We are gratified that courts all over the world are rejecting Apple’s strategy of refusing to pay for the use of our IP.

The iPhone models involved in the patent suit are iPhone 7, 7 Plus, 8, 8 Plus and X, which were found to infringe two Qualcomm patents, U.S. Patent No. 8,838,949 (“flashless booting”), and U.S. Patent No. 9,535,490 (data management between the applications processor and the modem); and the iPhone 8, 8 Plus and X which were found to infringe Qualcomm’s U.S. Patent No. 8,633,936 (high performance rich visual graphics with power management).

The patents are not contained in modems and are not standards-essential to cellular devices, Qualcomm said.

Reuters suggests the jury’s damages award could have wider significance if it ends up being factored into the looming billion dollar royalties suit between Apple and Qualcomm — by putting a dollar value on some of the latter’s IP, the San Diego trial potentially bolsters its contention that its chip licensing practices are fair, it said.

At the time of writing it’s not clear whether Apple intends to appeal the outcome of the trial. Reuters reports the iPhone maker declined to comment on that point, after expressing general disappointment with the outcome.

In a statement provided to the news agency Apple said: “Qualcomm’s ongoing campaign of patent infringement claims is nothing more than an attempt to distract from the larger issues they face with investigations into their business practices in U.S. federal court, and around the world.”

Cupertino filed its billion dollar royalties suit against Qualcomm two years ago.

It has reason to be bullish going into the trial, given a preliminary ruling Thursday — in which a U.S. federal court judge found Qualcomm owes Apple nearly $1BN in patent royalty rebate payments (via CNBC). The trial itself kicks off next month.

The U.S. Federal Trade Commission also filed antitrust charges against Qualcomm in 2017 — accusing the chipmaker of operating a monopoly and forcing exclusivity from Apple while charging “excessive” licensing fees for standards-essential patents.

That trial wrapped up in January and is pending a verdict from Judge Lucy Koh.

At the same time, Qualcomm has also been pursuing several international patent suits against Apple — also with some success.

In December Apple filed an appeal in China to overturn a preliminary ruling that could have blocked iPhone sales in the market.

While in Germany it did pull older iPhone models from sale in its own stores in January. But by February it was selling the two models again — albeit with Qualcomm chips, rather than Intel, inside.

Jam City is setting up a Toronto shop by buying Bingo Pop from Uken Games

The Los Angeles game development studio Jam City is setting up a shop in Toronto with the acquisition of Bingo Pop from Uken Games.

Terms of the deal weren’t disclosed.

The deal is part of a broader effort to expand the Jam City portfolio of games and geographic footprint. In recent months the company has inked agreements with Disney — taking over development duties on some of the company’s games like Disney Emoji Blitz and signing on to develop new ones — and launching new games in conjunction with other famous franchises like Harry Potter.

The Bingo Pop acquisition will bring a gambling game into the casual game developer’s stable of titles that pulled in roughly $700,000 in revenue through October, according to data from SensorTower.

Founded in Los Angeles in 2009 by DeWolfe, who previously helped create and launch Myspace, and 20th Century Fox exec Josh Yguado, Jam City rose to prominence on the back of its Cookie Jam and Panda Pop games. Now, the company has expanded through licensing deals with Harry Potter, Family Guy, Marvel and now Disney. Jam City has offices in Los Angeles, San Francisco, San Diego, Bogota and Buenos Aires.
