Zuckerberg admits it was a mistake not to ban Cambridge Analytica’s ads

Facebook didn’t ban Cambridge Analytica when it found out in 2015 that it had received user data from Dr. Aleksandr Kogan, and Zuckerberg called that a mistake during his testimony before the Senate. Cambridge Analytica has since been banned.

Zuckerberg explained that “I want to correct one thing that I said earlier in response to a question from Senator Leahy. He had asked why we didn’t ban Cambridge Analytica at the time when we learned of them in 2015. And I answered that what my understanding was was that they were not on the platform, were not an app developer or advertiser. When I went back and met with my team afterwards, they let me know that Cambridge Analytica actually did start as an advertiser later in 2015, so we could have in theory banned them back then, and made a mistake by not doing so.”

When the Guardian informed Facebook about Kogan sharing user data to Cambridge Analytica, Facebook banned Kogan, and required Cambridge Analytica to formally certify that it had deleted all the improperly attained user data. Cambridge Analytica did so, Zuckerberg confirmed in his prepared testimony for today. But Facebook then stopped short of blocking Cambridge Analytica from buying ads on its platform. The company went on to work with the Trump campaign to help it optimize political messaging and ad targeting.

Had Facebook banned Cambridge Analytica at the time, it wouldn’t have been able to buy ads directly on behalf of political campaigns with which it worked. However, the company might still have been able to help these campaigns to optimize their ads, so a 2015 ban wouldn’t have necessarily prevented second-hand use of improperly attained data.

Mark Zuckerberg: ‘There will always be a version of Facebook that is free’

Today during Mark Zuckerberg’s testimony before the Senate, the Facebook CEO reiterated that “there will always be a version of Facebook that is free.”

In the midst of the Cambridge Analytica scandal, in which the user data of up to 87 million people was sold by a third-party developer to Trump Campaign-linked firm Cambridge Analytica, there has been talk of Facebook potentially adding a subscription layer.

The scandal has brought to light the heart of a problem that many have been well aware of: if you’re not buying a product, you are the product.

Last week, when asked if there might be a way for users to opt out of being targeted for ads, Sandberg responded saying they’d have to pay for it.

“We have different forms of opt-out,” Sandberg replied. “We don’t have an opt-out at the highest level. That would be a paid product.”

Our own Josh Constine made an argument that ad-free subscriptions could save Facebook. And while there’s no word on an ad-free subscription, Zuckerberg did at least leave room for it in the future, noting that there will always be a version of Facebook that is free.

“How do you sustain a business model in which users don’t pay for your service?” Senator Orrin Hatch asked Zuckerberg.

“Senator, we run ads.”

Today, Facebook CEO Mark Zuckerberg will begin two of the most publicly scrutinized days of his career.

This afternoon, members of the Senate will hear from Zuckerberg on data use, protection and privacy in the midst of the Cambridge Analytica scandal and Russian election meddling. While Zuckerberg’s prepared statement has already been released to the public, there are plenty of lingering questions to be answered.

We’ll be watching diligently and bringing you all the breaking news and analysis from the hearing. But if you want to watch along yourself, here’s what you need to know:

Facebook demands ID verification for big Pages, ‘issue’ ad buyers

Facebook is looking to self-police by implementing parts of the proposed Honest Ads Act before the government tries to regulate it. To fight fake news and election interference, Facebook will require the admins of popular Facebook Pages and advertisers buying political or “issue” ads on “debated topics of national legislative importance” like education or abortion to verify their identity and location. Those that refuse, are found to be fraudulent or are trying to influence foreign elections will have their Pages prevented from posting to the News Feed or their ads blocked.

Meanwhile, Facebook plans to use this information to append a “Political Ad” label and “Paid for by” information to all election, politics and issue ads. Users can report any ads they think are missing the label, and Facebook will show if a Page has changed its name to thwart deception. Facebook started the verification process this week; users in the U.S. will start seeing the labels and buyer info later this spring, and Facebook will expand the effort to ads around the world in the coming months.

This verification and name change disclosure process could prevent hugely popular Facebook Pages from being built up around benign content, then sold to cheats or trolls who switch to sharing scams or misinformation.

Overall, it’s a smart start that comes way too late. As soon as Facebook started heavily promoting its ability to run influential election ads, it should have voluntarily adopted similar verification and labeling rules as traditional media. Instead, it was so focused on connecting people to politics, it disregarded how the connection could be perverted to power mass disinformation and destabilization campaigns.

“These steps by themselves won’t stop all people trying to game the system. But they will make it a lot harder for anyone to do what the Russians did during the 2016 election and use fake accounts and pages to run ads,” CEO Mark Zuckerberg wrote on Facebook. “Election interference is a problem that’s bigger than any one platform, and that’s why we support the Honest Ads Act. This will help raise the bar for all political advertising online.” You can see his full post below.

The move follows Twitter’s November announcement that it too would label political ads and show who purchased them.

Facebook also gave a timeline for releasing both its tools for viewing all ads run by Pages and to create a Political Ad Archive. A searchable index of all ads with the “political” label, including their images, text, target demographics and how much was spent on them, will launch in June and keep ads visible for four years after they run. Meanwhile, the View Ads tool that’s been testing in Canada will roll out globally in June so users can see any ad run by a Page, not just those targeted to them.

Facebook announced in October it would require documentation from election advertisers and label their ads, but now is applying those requirements to a much wider swath of ads that deal with big issues impacted by politics. That could protect users from disinformation and divisive content not just during elections, but any time bad actors are trying to drive wedges into society. Facebook wouldn’t reveal the threshold of followers that will trigger Pages needing verification, but confirmed it will not apply to small to medium-size businesses.

By self-regulating, Facebook may be able to take the wind out of calls for new laws that apply to online ads buyer disclosure rules on TV and other traditional media ads. Zuckerberg will testify before the U.S. Senate Judiciary and Commerce committees on April 10, as well as the House Energy and Commerce Committee on April 11. Having today’s announcement to point to could give him more protection against criticism during the hearings, though Congress will surely want to know why these safeguards weren’t in place already.

Zuckerberg will also testify before the Senate

Earlier this week, the House Energy and Commerce Committee announced that Facebook CEO Mark Zuckerberg is slated to testify on the use and protection of user data in Washington D.C. on April 11. Turns out, Zuckerberg will have a busier week in D.C. than expected, with the Senate Judiciary and Senate Commerce Committees announcing a joint hearing with the Facebook boss.

The Senate hearing will go down on April 10, a day before Zuckerberg appears before the House Committee.

The hearing, convened by Senate Committee on the Judiciary Chairman Chuck Grassley (R-Iowa) and Senate Commerce, Science and Transportation Committee Chairman John Thune (R-S.D.), is titled “Facebook, Social Media Privacy, and the Use and Abuse of Data.”

The hearing will take place in the U.S. Capitol Visitors Center at 2:15pm ET.

Here’s what Senator Thune had to say in a prepared statement:

Facebook now plays a critical role in many social relationships, informing Americans about current events, and pitching everything from products to political candidates. Our joint hearing will be a public conversation with the CEO of this powerful and influential company about his vision for addressing problems that have generated significant concern about Facebook’s role in our democracy, bad actors using the platform, and user privacy.

Zuckerberg brought up the possibility of speaking to congress in late March, saying: “If it is ever the case that I am the most informed person at Facebook in the best position to testify, I will happily do that.”

Facebook retracted Zuckerberg’s messages from recipients’ inboxes

You can’t remove Facebook messages from the inboxes of people you sent them to, but Facebook did that for Mark Zuckerberg and other executives. Three sources confirm to TechCrunch that old Facebook messages they received from Zuckerberg have disappeared from their Facebook inboxes, while their own replies to him conspicuously remain. An email receipt of a Facebook message from 2010 reviewed by TechCrunch proves Zuckerberg sent people messages that no longer appear in their Facebook chat logs or in the files available from Facebook’s Download Your Information tool.

When asked by TechCrunch about the situation, Facebook claimed in this statement it was done for corporate security:

“After Sony Pictures’ emails were hacked in 2014 we made a number of changes to protect our executives’ communications. These included limiting the retention period for Mark’s messages in Messenger. We did so in full compliance with our legal obligations to preserve messages.”

However, Facebook never publicly disclosed the removal of messages from users’ inboxes, nor privately informed the recipients. That raises the question of whether this was a breach of user trust. When asked that question directly over Messenger, Zuckerberg declined to provide a statement.

Tampering with users’ inboxes

A Facebook spokesperson confirmed to TechCrunch that users can only delete messages from their own inboxes, and that they would still show up in the recipient’s thread. There appears to be no “retention period” for normal users’ messages, as my inbox shows messages from as early as 2005. That indicates Zuckerberg and other executives received special treatment in being able to pull back previously sent messages.

[Update 4/6/2018: Facebook now says that it plans to launch an “unsend” feature for Facebook messages to all users in the next several months, and won’t let Mark Zuckerberg use that feature any more until it launches for everyone. One option Facebook is considering for the Unsend feature is an expiration timer users could set. But it’s alarming that Facebook didn’t disclose the retractions or plans for a Unsend button until forced, and scrambling to give everyone the feature seems like an effort to quiet users’ anger over the situation.]

Facebook chats sent by Zuckerberg from several years ago or older were missing from the inboxes of both former employees and non-employees. What’s left makes it look like the recipients were talking to themselves, as only their side of back-and-forth conversations with Zuckerberg still appear. Three sources asked to remain anonymous out of fear of angering Zuckerberg or burning bridges with the company.

[Update: Recent messages from Zuckerberg remain in users’ inboxes. Old messages from before 2014 still appear to some users, indicating the retraction did not apply to all chats the CEO sent. But more sources have come forward since publication, saying theirs disappeared, as well.]

None of Facebook’s terms of service appear to give it the right to remove content from users’ accounts unless it violates the company’s community standards. While it’s somewhat standard for corporations to have data retention policies that see them delete emails or other messages from their own accounts that were sent by employees, they typically can’t remove the messages from the accounts of recipients outside the company. It’s rare that these companies own the communication channel itself and therefore host both sides of messages as Facebook does in this case, which potentially warrants a different course of action with more transparency than quietly retracting the messages.

Facebook’s power to tamper with users’ private message threads could alarm some. The issue is amplified by the fact that Facebook Messenger now has 1.3 billion users, making it one of the most popular communication utilities in the world.

Zuckerberg is known to have a team that helps him run his Facebook profile, with some special abilities for managing his 105 million followers and constant requests for his attention. For example, Zuckerberg’s profile doesn’t show a button to add him as a friend on desktop, and the button is grayed out and disabled on mobile. But the ability to change the messaging inboxes of other users is far more concerning.

Facebook may have sought to prevent leaks of sensitive corporate communications. Following the Sony hack, emails of Sony’s president Michael Lynton, who sat on Snap Inc.’s board, were exposed, revealing secret acquisitions and strategy.

However, Facebook also may have looked to thwart the publication of potentially embarrassing personal messages sent by Zuckerberg or other executives. In 2010, Silicon Alley Insider aka Business Insider published now-infamous instant messages from a 19-year-old Zuckerberg to a friend shortly after starting The Facebook in 2004. “yea so if you ever need info about anyone at harvard . . . just ask . . . i have over 4000 emails, pictures, addresses, sns” Zuckerberg wrote to a friend. “what!? how’d you manage that one?” they asked. “people just submitted it . .  i don’t know why . . . they ‘trust me’ . . . dumb fucks” Zuckerberg explained.

The New Yorker later confirmed the messages with Zuckerberg, who told the publication he “absolutely” regretted them. “If you’re going to go on to build a service that is influential and that a lot of people rely on, then you need to be mature, right? I think I’ve grown and learned a lot,” said Zuckerberg.

If the goal of Facebook’s security team was to keep a hacker from accessing the accounts of executives and therefore all of their messages, they could have merely been deleted on their side the way any Facebook user is free to do, without them disappearing from the various recipients’ inboxes. If Facebook believed it needed to remove the messages entirely from its servers in case the company’s backend systems we breached, a disclosure of some kind seems reasonable.

Now as Facebook encounters increased scrutiny regarding how it treats users’ data in the wake of the Cambridge Analytica scandal, the retractions could become a bigger issue. Zuckerberg is slated to speak in front of the U.S. Senate Judiciary and Commerce committees on April 10, as well as the House Energy and Commerce Committee on April 11. They could request more information about Facebook removing messages or other data from users’ accounts without their consent. While Facebook is trying to convey that it understands its responsibilities, the black mark left on public opinion by past behavior may prove permanent.

Highlights and audio from Zuckerberg’s emotional Q&A on scandals

“This is going to be a never-ending battle,” said Mark Zuckerberg . He just gave the most candid look yet into his thoughts about Cambridge Analytica, data privacy and Facebook’s sweeping developer platform changes during a conference call with reporters today. Sounding alternately vulnerable about his past negligence and confident about Facebook’s strategy going forward, Zuckerberg took nearly an hour of tough questions.

The CEO started the call by giving his condolences to those affected by the shooting at YouTube yesterday. He then delivered this mea culpa on privacy:

We’re an idealistic and optimistic company … but it’s clear now that we didn’t do enough. We didn’t focus enough on preventing abuse and thinking through how people could use these tools to do harm as well … We didn’t take a broad enough view of what our responsibility is and that was a huge mistake. That was my mistake.

It’s not enough to just connect people. We have to make sure those connections are positive and that they’re bringing people together.  It’s not enough just to give people a voice, we have to make sure that people are not using that voice to hurt people or spread misinformation. And it’s not enough to give people tools to sign into apps, we have to make sure that all those developers protect people’s information too.

It’s not enough to have rules requiring that they protect the information. It’s not enough to believe them when they’re telling us they’re protecting information. We actually have to ensure that everyone in our ecosystem protects people’s information.

This is Zuckerberg’s strongest statement yet about his and Facebook’s failure to anticipate worst-case scenarios, which has led to a string of scandals that are now decimating the company’s morale. Spelling out how policy means nothing without enforcement, and pairing that with a massive reduction in how much data app developers can request from users makes it seem like Facebook is ready to turn over a new leaf.

Here are the highlights from the rest of the call:

On Zuckerberg calling fake news’ influence “crazy”: “I clearly made a mistake by just dismissing fake news as crazy — as having an impact … it was too flippant. I never should have referred to it as crazy.

On deleting Russian trolls: Not only did Facebook delete 135 Facebook and Instagram accounts belonging to Russian government-connected election interference troll farm the Internet Research Agency, as Facebook announced yesterday, Zuckerberg said Facebook removed “a Russian news organization that we determined was controlled and operated by the IRA.”

On the 87 million number: Regarding today’s disclosure that up to 87 million people had their data improperly accessed by Cambridge Analytica, “it very well could be less but we wanted to put out the maximum that we felt it could be as soon as we had that analysis.” Zuckerberg also referred to The New York Times’ report, noting that “We never put out the 50 million number, that was other parties.”

On users having their public info scraped: Facebook announced this morning that “we believe most people on Facebook could have had their public profile scraped” via its search by phone number or email address feature and account recovery system. Scammers abused these to punch in one piece of info and then pair it to someone’s name and photo. Zuckerberg said search features are useful in languages where it’s hard to type or a lot of people have the same names. But “the methods of react limiting this weren’t able to prevent malicious actors who cycled through hundreds of thousands of IP addresses and did a relatively small number of queries for each one, so given that and what we know to day it just makes sense to shut that down.”

On when Facebook learned about the scraping and why it didn’t inform the public sooner:  “We looked into this and understood it more over the last few days as part of the audit of our overall system,” Zuckerberg said, declining to specify when Facebook first identified the issue. [Update: Facebook later specified that the sophisticated scraping had been picked up in the past few weeks during the audit, recently confirmed, and that the company disclosed the situation as soon as it had details ready.]

On implementing GDPR worldwide: Zuckerberg refuted a Reuters story from yesterday saying that Facebook wouldn’t bring GDPR privacy protections to the U.S. and elsewhere. Instead he says, “we’re going to make all the same controls and settings available everywhere, not just in Europe.”

On if board has discussed him stepping down as chairman: “Not that I’m aware of,” Zuckerberg said happily.

On if he still thinks he’s the best person to run Facebook: “Yes. Life is about learning from the mistakes and figuring out what you need to do to move forward … I think what people should evaluate us on is learning from our mistakes … and if we’re building things people like and that make their lives better … there are billions of people who love the products we’re building.”

On the Boz memo and prioritizing business over safety: “The things that makes our product challenging to manage and operate are not the trade-offs between people and the business. I actually think those are quite easy because over the long-term, the business will be better if you serve people. I think it would be near-sighted to focus on short-term revenue over people, and I don’t think we’re that short-sighted. All the hard decisions we have to make are trade-offs between people. Different people who use Facebook have different needs. Some people want to share political speech that they think is valid, and other people feel like it’s hate speech … we don’t always get them right.”

On whether Facebook can audit all app developers: “We’re not going to be able to go out and necessarily find every bad use of data,” Zuckerberg said, but confidently said, “I actually do think we’re going to be able to cover a large amount of that activity.”

On whether Facebook will sue Cambridge Analytica: “We have stood down temporarily to let the [U.K. government] do their investigation and their audit. Once that’s done we’ll resume ours … and ultimately to make sure none of the data persists or is being used improperly. And at that point if it makes sense we will take legal action if we need to do that to get people’s information.”

On how Facebook will measure its impact on fixing privacy: Zuckerberg wants to be able to measure “the prevalence of different categories of bad content like fake news, hate speech, bullying, terrorism … That’s going to end up being the way we should be held accountable and measured by the public … My hope is that over time the playbook and scorecard we put out will also be followed by other internet platforms so that way there can be a standard measure across the industry.”

On whether Facebook should try to earn less money by using less data for targeting: “People tell us if they’re going to see ads they want the ads to be good … that the ads are actually relevant to what they care about … On the one hand people want relevant experiences, and on the other hand I do think there’s some discomfort with how data is used in systems like ads. But I think the feedback is overwhelmingly on the side of wanting a better experience. Maybe it’s 95-5.”

On whether #DeleteFacebook has had an impact on usage or ad revenue: “I don’t think there’s been any meaningful impact that we’ve observed… but it’s not good.”

On the timeline for fixing data privacy: “This is going to be a never-ending battle. You never fully solve security. It’s an arms race,” Zuckerberg said early in the call. Then to close Q&A, he said, “I think this is a multi-year effort. My hope is that by the end of this year we’ll have turned the corner on a lot of these issues and that people will see that things are getting a lot better.”

Overall, this was the moment of humility, candor and contrition Facebook desperately needed. Users, developers, regulators and the company’s own employees have felt in the dark this last month, but Zuckerberg did his best to lay out a clear path forward for Facebook. His willingness to endure these questions was admirable, even if he deserved the grilling.

The company’s problems won’t disappear, and its past transgressions can’t be apologized away. But Facebook and its leader have finally matured past the incredulous dismissals and paralysis that characterized its response to past scandals. It’s ready to get to work.

Cambridge Analytica denies accessing data on 87M Facebook users…claims 30M

Cambridge Analytica is refuting a report by Facebook today that said Cambridge Analytica improperly attained data on up to 87 million users. Instead, it claims it only “licensed data for no more than 30 million people” from Dr. Aleksandr Kogan’s research company Global Science Research. It also claims none of this data was used in work on the 2016 U.S. presidential election when it was hired by the Trump campaign, and that upon notice from Facebook immediately deleted all raw data and began removing derivative data.

The whole statement from Cambridge Analytica can be found below. We requested a comment from Facebook about the incongruencies in the two companies’ positions, but the social network declined to comment.

The he-said-she-said of the scandal seems to be amplifying as Facebook continues to endure criticism about weak data privacy policies and enforcement that led to the Cambridge Analytica fiasco that’s seen Facebook’s market cap drop nearly $100 billion.

Today Facebook announced the 87 million figure as a maximum number of people potentially impacted and said it would notify those users with an alert atop the News Feed. It also rewrote its Terms of Service today to clarify how it collects and works with outside developers, and announced sweeping platform API restrictions that will break many apps built on Facebook but prevent privacy abuses. Zuckerberg then held a conference call with reporters to give insight on all the news.

Cambridge Analytica has repeatedly denied assertions about interactions with Facebook data, but Facebook hasn’t backed down. Instead, Facebook has used Cambridge Analytica as an example of abuse it’s trying to combat, and as a justification for cracking down on developers both malicious and benign around the world.

Today Facebook reported that information for up to 87 million people may have been improperly obtained by research company GSR. Cambridge Analytica licensed data for  from GSR, as is clearly stated in our contract with the research company. We did not receive more data than this.

We did not use any GSR data in the work we did in the 2016 US presidential election.

Our contract with GSR stated that all data must be obtained legally, and this contract is now a matter of public record. We took legal action against GSR when we found out they had breached this contract.When Facebook contacted us to let us know the data had been improperly obtained, we immediately deleted the raw data from our file server, and began the process of searching for and removing any of its derivatives in our system.

When Facebook sought further assurances a year ago, we carried out an internal audit to make sure that all the data, all derivatives, and all backups had been deleted, and gave Facebook a certificate to this effect.

We are now undertaking an independent third-party audit to demonstrate that no GSR data remains in our systems.

The real threat to Facebook is the Kool-Aid turning sour

These kinds of leaks didn’t happen when I started reporting on Facebook eight years ago. It was a tight-knit cult convinced of its mission to connect everyone, but with the discipline of a military unit where everyone knew loose lips sink ships. Motivational posters with bold corporate slogans dotted its offices, rallying the troops. Employees were happy to be evangelists.

But then came the fake news, News Feed addiction, violence on Facebook Live, cyberbullying, abusive ad targeting, election interference and, most recently, the Cambridge Analytica app data privacy scandals. All the while, Facebook either willfully believed the worst case scenarios could never come true, was naive to their existence or calculated the benefits and growth outweighed the risks. And when finally confronted, Facebook often dragged its feet before admitting the extent of the issues.

Inside the social network’s offices, the bonds began to fray. An ethics problem metastisized into a morale problem. Slogans took on sinister second meanings. The Kool-Aid tasted different.

Some hoped they could right the ship but couldn’t. Some craved the influence and intellectual thrill of running one of humanity’s most popular inventions, but now question if that influence and their work is positive. Others surely just wanted to collect salaries, stock and resumé highlights, but lost the stomach for it.

Now the convergence of scandals has come to a head in the form of constant leaks.

The trouble tipping point

The more benign leaks merely cost Facebook a bit of competitive advantage. We’ve learned it’s building a smart speaker, a standalone VR headset and a Houseparty split-screen video chat clone.

Yet policy-focused leaks have exacerbated the backlash against Facebook, putting more pressure on the conscience of employees. As blame fell to Facebook for Trump’s election, word of Facebook prototyping a censorship tool for operating in China escaped, triggering questions about its respect for human rights and free speech. Facebook’s content rulebook got out alongside disturbing tales of the filth the company’s contracted moderators have to sift through. Its ad targeting was revealed to be able to pinpoint emotionally vulnerable teens.

In recent weeks, the leaks have accelerated to a maddening pace in the wake of Facebook’s soggy apologies regarding the Cambridge Analytica debacle. Its weak policy enforcement left the door open to exploitation of data users gave third-party apps, deepening the perception that Facebook doesn’t care about privacy.

And it all culminated with BuzzFeed publishing a leaked “growth at all costs” internal post from Facebook VP Andrew “Boz” Bosworth that substantiated people’s worst fears about the company’s disregard for user safety in pursuit of world domination. Even the ensuing internal discussion about the damage caused by leaks and how to prevent them…leaked.

But the leaks are not the disease, just the symptom. Sunken morale is the cause, and it’s dragging down the company. Former Facebook employee and Wired writer Antonio Garcia Martinez sums it up, saying this kind of vindictive, intentionally destructive leak fills Facebook’s leadership with “horror”:

The fact that some Facebooker would place their personal grudge and views above the interests of the company fills anyone on the home team with horror (in the same way that the current administration colluding with foreigners to secure a domestic victory does Americans).

And that sentiment was confirmed by Facebook’s VP of News Feed Adam Mosseri, who tweeted that leaks “create strong incentives to be less transparent internally and they certainly slow us down,” and will make it tougher to deal with the big problems.

Those thoughts weigh heavy on Facebook’s team. A source close to several Facebook executives tells us they feel “embarrassed to work there” and are increasingly open to other job opportunities. One current employee told us to assume anything certain execs tell the media is “100% false.”

If Facebook can’t internally discuss the problems it faces without being exposed, how can it solve them?

Implosion

The consequences of Facebook’s failures are typically pegged as external hazards.

You might assume the government will finally step in and regulate Facebook. But the Honest Ads Act and other rules about ads transparency and data privacy could end up protecting Facebook by being simply a paperwork speed bump for it while making it tough for competitors to build a rival database of personal info. In our corporation-loving society, it seems unlikely that the administration would go so far as to split up Facebook, Instagram and WhatsApp — one of the few feasible ways to limit the company’s power.

Users have watched Facebook make misstep after misstep over the years, but can’t help but stay glued to its feed. Even those who don’t scroll rely on it as a fundamental utility for messaging and login on other sites. Privacy and transparency are too abstract for most people to care about. Hence, first-time Facebook downloads held steady and its App Store rank actually rose in the week after the Cambridge Analytica fiasco broke. In regards to the #DeleteFacebook movement, Mark Zuckerberg himself said “I don’t think we’ve seen a meaningful number of people act on that.” And as long as they’re browsing, advertisers will keep paying Facebook to reach them.

That’s why the greatest threat of the scandal convergence comes from inside. The leaks are the canary in the noxious blue coal mine.

Can Facebook survive slowing down?

If employees wake up each day unsure whether Facebook’s mission is actually harming the world, they won’t stay. Facebook doesn’t have the same internal work culture problems as some giants like Uber. But there are plenty of other tech companies with less questionable impacts. Some are still private and offer the chance to win big on an IPO or acquisition. At the very least, those in the Bay could find somewhere to work without a spending hours a day on the traffic-snarled 101 freeway.

If they do stay, they won’t work as hard. It’s tough to build if you think you’re building a weapon. Especially if you thought you were going to be making helpful tools. The melancholy and malaise set in. People go into rest-and-vest mode, living out their days at Facebook as a sentence not an opportunity. The next killer product Facebook needs a year or two from now might never coalesce.

And if they do work hard, a culture of anxiety and paralysis will work against them. No one wants to code with their hands tied, and some would prefer a less scrutinized environment. Every decision will require endless philosophizing and risk-reduction. Product changes will be reduced to the lowest common denominator, designed not to offend or appear too tyrannical.

In fact, that’s partly how Facebook got into this whole mess. A leak by an anonymous former contractor led Gizmodo to report Facebook was suppressing conservative news in its Trending section. Terrified of appearing liberally biased, Facebook reportedly hesitated to take decisive action against fake news. That hands-off approach led to the post-election criticism that degraded morale and pushed the growing snowball of leaks down the mountain.

It’s still rolling.

How to stop morale’s downward momentum will be one of Facebook’s greatest tests of leadership. This isn’t a bug to be squashed. It can’t just roll back a feature update. And an apology won’t suffice. It will have to expel or reeducate the leakers and those disloyal without instilling a witch hunt’s sense of dread. Compensation may have to jump upwards to keep talent aboard like Twitter did when it was floundering. Its top brass will need to show candor and accountability without fueling more indiscretion. And it may need to make a shocking, landmark act of contrition to convince employees its capable of change.

When asked how Facebook could address the morale problem, Mosseri told me “it starts with owning our mistakes and being very clear about what we’re doing now” and noted that “it took a while to get into this place and I think it’ll take a while to work our way out . . . Trust is lost quickly, and takes a long time to rebuild.”

This isn’t about whether Facebook will disappear tomorrow, but whether it will remain unconquerable for the forseeable future.

Growth has been the driving mantra for Facebook since its inception. No matter how employees are evaluated, it’s still the underlying ethos. Facebook has poised itself as a mission-driven company. The implication was always that connecting people is good so connecting more people is better. The only question was how to grow faster.

Now Zuckerberg will have to figure out how to get Facebook to cautiously foresee the consequences of what it says and does while remaining an appealing place to work. “Move slow and think things through” just doesn’t have the same ring to it.

Regulation could protect Facebook, not punish it

You know what tech startups hate? Complicated legal compliance. The problem is, Facebook isn’t a startup any more, but its competitors are.

There have been plenty of calls from congress and critics to regulate Facebook following the election interference scandal and now the Cambridge Analytica debacle. The government could require extensive ads transparency reporting or data privacy protections. That could cost Facebook a lot of money, slow down its operations, or inhibit its ability to build new products.

But the danger is that those same requirements could be much more onerous for a tiny upstart company to uphold. Without much cash or enough employees, and with product-market fit still to nail down, young startups might be anchored by the weight of regulation. It could prevent them from ever rising to become a true alternative to Facebook. Venture capitalists choosing whether to fund the next Facebook killer might look at the regulations as too high of a price of entry.

The lack of viable alternatives has made the #DeleteFacebook movement toothless. Where are people going to go? Instagram? WhatsApp? The government already missed its chances to stop Facebook from acquiring these companies that are massive social networks in their own right.

The only social networks to carve out communities since Facebook’s rise did so largely by being completely different, like the ephemeral Snapchat that purposefully doesn’t serve as a web identity platform, and the mostly-public Twitter that caters to thought leaders and celebrities more than normal people sharing their personal lives. Blockchain-based decentralized social networks sound nice but may be impossible to spin up.

That’s left few places for Facebook haters to migrate. This might explain why despite having so many more users, #DeleteFacebook peaked last week at substantially fewer Twitter mentions than the big #DeleteUber campaign from last January, according to financial data dashboard Sentieo. Lyft’s existence makes #DeleteUber a tenable stance, because you don’t have to change your behavior pattern, just your brand of choice.

If the government actually wants to protect the public against Facebook abusing its power, it would need to go harder than the Honest Ads Act that would put political advertising on Internet platforms under the same scrutiny regarding disclosure of buyers as the rules for TV and radio advertising. That’s basically just extra paperwork for Facebook. We’ve seen regulatory expenses deter competition amongst broadband internet service providers and in other industries. Real change would necessitate regulation that either creates alternatives to Facebook or at least doesn’t inhibit their creation.

That could mean only requiring certain transparency and privacy protections from apps over a certain size, like 200 million daily users. This would put the cap a bit above Twitter and Snapchat’s size today, giving them time to prepare for compliance, while immediately regulating Facebook, Messenger, Instagram, WhatsApp, and Google’s social problem child YouTube.

Still, with Facebook earning billions in profit per quarter and a massive war chest built up, Mark Zuckerberg could effectively pay his way out of the problem. That’s why it makes perfect sense for him to have told CNN “I’m not sure we shouldn’t be regulated” and that “There are things like ad transparency regulation that I would love to see.” Particular regulatory hurdles amount to just tiny speed bumps for Facebook. Courting this level of regulation could bat down the question of whether it should be broken up or its News Feed algorithm needs to change.

Meanwhile, if the government instituted new rules for tech platforms collecting persona information going forward, it could effectively lock in Facebook’s lead in the data race. If it becomes more cumbersome to gather this kind of data, no competitor might ever amass an index of psychographic profiles and social graphs able to rival Facebook’s.

A much more consequential approach would be to break up Facebook, Instagram, and WhatsApp. Facebook is trying to preempt these drastic measures with Zuckerberg’s recent apology tour and its purchase of full-page ads in nine newspapers today claiming it understands its responsibility.

Establishing them as truly independent companies that compete would create meaningful alternatives to Facebook. Instagram and WhatsApp would have to concern themselves with actually becoming sustainable businesses. They’d all lose some economies of data scale, forfeiting the ability to share engineering, anti-spam, localization, ad sales, and other resources that a source close to Instagram told me it gained by being acquired in 2012, and that Facebook later applied to WhatsApp too.

Both permanent photo sharing and messaging would become two-horse races again. That could lead to the consumer-benefiting competition and innovation the government hopes for from regulation.

Yet with strong regulation like dismantling Facebook seeming beyond the resolve of congress, and weak regulation potentially protecting Facebook, perhaps it’s losing the moral high ground that will be Facebook’s real punishment.

We’ve already seen that first-time download rates aren’t plummeting for Facebook, its App Store ranking has actually increased since the Cambridge Analytica scandal broke, and blue chip advertisers aren’t bailing, according to BuzzFeed. But Facebook relies on the perception of its benevolent mission to recruit top talent in Silicon Valley and beyond.

Techies take the job because they wake up each day believing that they’re having a massive positive influence by connecting the world. These people could have founded or worked at a new startup where they’d have discernible input on the direction of the product, and a chance to earn huge return multiples on their stock. Many have historically worked at Facebook because its ads say it’s the “Best place to build and make an impact”.

But if workers start to see that impact as negative, they might not enlist. This is what could achieve that which surface-level regulation can’t. It’s perhaps the most important repercussion of all the backlash about fake news, election interference, well-being, and data privacy: that losing talent could lead to a slow-down of innovation at Facebook that might  leave the door open for a new challenger.
