In October, TikTok href=”https://techcrunch.com/2019/10/15/tiktok-taps-corporate-law-firm-kl-gates-to-advise-on-its-u-s-content-moderation-policies/”> tapped corporate law firm K&L Gates to advise the company on its moderation policies and other topics afflicting social media platforms. As a part of those efforts, TikTok said it would form a new committee of experts to advise the business on topics like child safety, hate speech, misinformation, bullying and other potential problems. Today, TikTok is announcing the technology and safety experts who will be the company’s first committee members.
The committee, known as the TikTok Content Advisory Council, will be chaired by Dawn Nunziato, a professor at George Washington University Law School and co-director of the Global Internet Freedom Project. Nunziato specializes in free speech issues and content regulation — areas where TikTok has fallen short.
“A company willing to open its doors to outside experts to help shape upcoming policy shows organizational maturity and humility,” said Nunziato, of her joining. “I am working with TikTok because they’ve shown that they take content moderation seriously, are open to feedback and understand the importance of this area both for their community and for the future of healthy public discourse,” she added.
TikTok says it plans to grow the committee to around a dozen experts in time.

Nunziato’s view of TikTok — of a company being open and willing to change — is a charitable one, it should be said.
The company is in dangerous territory here in the U.S., despite its popularity among Gen Z and millennial users. TikTok today is facing a national security review and a potential ban on all government workers’ phones. In addition, the Dept. of Defense suggested the app should be blocked on phones belonging to U.S. military personnel. Its 2017 acquisition of U.S.-based Musical.ly may even come under review.
Though known for its lighthearted content — like short videos of dances, comedy and various other creative endeavors — TikTok has also been accused of things like censoring the Hong Kong protests and more, which contributed to U.S. lawmakers’ fears that the Chinese-owned company may have to comply with “state intelligence work.”
TikTok has also been accused of having censored content from unattractive, poor or disabled persons, as well as videos from users identified as LGBTQ+. The company explained in December these guidelines are no longer used, as they were an early and misguided attempt to protect users from online bullying. TikTok had limited the reach of videos where such harassment could occur. But this suppression was done in the dark, unasked for by the “protected” parties — and it wasn’t until exposed by German site NetzPolitik that anyone knew these rules had existed.
In light of the increased scrutiny of its platform and its ties to China, TikTok has been taking a number of steps in an attempt to change its perception. The company released new Community Guidelines and published its first Transparency Report a few months ago. It also hired a global General Counsel and expanded its Trust & Safety hubs in the U.S., Ireland and Singapore. And it just announced a Transparency Center open to outside experts who want to review its moderation practices.
TikTok’s new Advisory Council will meet with the company’s U.S. leadership to focus on the key topics of importance starting at the end of the month, with an early focus on creating policies around misinformation and election interference.

Instagram is embracing its potential as a news source, employing its ubiquity to distribute coronavirus prevention techniques through a new call-out at the top of its homescreen feed. In some countries, Instagram will show a link to information from the World Health Organization and local health ministries, along with a message like this: “Help Prevent the Spread of Coronavirus: See the latest information from the World Health Organization so you can help prevent the spread of COVID-19. — Go to who.int”.
An Instagram spokesperson tells TechCrunch that the notice will start appearing in countries that have seen significant impact from the virus.

Additionally, Instagram is preventing users from searching for COVID-19-related augmented reality effects unless they were made in partnership with legitimate health organizations. This could limit the spread of disinformation or insensitive jokes about the virus. Instagram was already sending false information to fact checkers and listing official health sources atop the search results for coronavirus-related queries.
To help the company stay focused, Facebook is also shutting down the MSQRD app it acquired in 2016 to jumpstart is AR face filters feature. MSQRD will become unavailable on April 13th, though its tech is already fully integrated into Facebook and Instagram.
Meanwhile, on Snapchat, the company prohibits partners from sharing misinformation, relying on its closed platform to prevent the false news hoaxes that have plagued open platforms like Facebook. Snapchat is also highlighting health information shared by its Discover partners, including NBC’s Stay Tuned, Sky News, The Wall Street Journal, The Washington Post, CNN and NowThis. These are smart efforts by social platforms that know they might get opened by more people more often than some traditional news sources. With over 1 billion monthly users on Instagram and over 200 million daily users on Snapchat, they have the power to spread vital information and act as a new form of the emergency broadcast system.

The JEDI contract award process might never be done. Following legal challenges from Amazon after the Pentagon’s massive, $10 billion cloud contract was awarded to Microsoft in October, the Pentagon indicated in court documents last night that it wishes to reconsider the award.
It’s just the latest plot twist in an epic government procurement saga.
Here’s what we know. The Pentagon filing is based on Amazon’s complaints about the technical part of the deal only. Amazon has said that it believes political interference influenced the awarding of the contract. However, the cloud computing giant also believes it beat Microsoft on the technical merits in a majority of instances required in the request for proposals issued by the Pentagon.
In fact, sources told TechCrunch, “AWS’s protest identified evaluation errors, clear deficiencies and unmistakable bias in six of the eight evaluation factors.”
Obviously Amazon was happy to hear this news. “We are pleased that the DoD has acknowledged ‘substantial and legitimate’ issues that affected the JEDI award decision, and that corrective action is necessary,” a spokesperson stated.
“We look forward to complete, fair, and effective corrective action that fully insulates the re-evaluation from political influence and corrects the many issues affecting the initial flawed award.”
As would expect, Microsoft thinks that the DoD made the correct choice, and believes the review will bear that out. “Over two years, the DoD reviewed dozens of factors and sub factors and found Microsoft equal or superior to AWS on every factor. We remain confident that Microsoft’s proposal was technologically superior, continues to offer the best value, and is the right choice for the DoD,” Microsoft VP of communications Frank Shaw said.
The court granted the Pentagon 120 days to review the results again, but indicated it could take longer. In the meantime, the project is at a standstill.
On Friday, the court issued a ruling that Amazon was likely to succeed on its complaint on merit, and that could have been the impetus of this latest action by the Pentagon.
While the political influence piece might not be overtly part of this filing, it does lurk in the background. The president has made it clear that he doesn’t like Amazon founder and CEO Jeff Bezos, who also owns The Washington Post. As we wrote last year:
Amazon, for instance, could point to Jim Mattis’ book where he wrote that the president told the then Defense Secretary to “screw Bezos out of that $10 billion contract.” Mattis says he refused, saying he would go by the book, but it certainly leaves the door open to a conflict question.
As we previously reported, AWS CEO Andy Jassy stated at a press event at AWS re:Invent in December that the company believed there was political bias at play in the decision-making process.
“What I would say is that it’s fairly obvious that we feel pretty strongly that it was not adjudicated fairly,” he said. He added, “I think that we ended up with a situation where there was political interference. When you have a sitting president, who has shared openly his disdain for a company, and the leader of that company, it makes it really difficult for government agencies, including the DoD, to make objective decisions without fear of reprisal.”

Censorship takes many forms, but even the most restrictive countries can’t block every single path for information they’d rather not get in (or out). Reporters Without Borders has identified a surprising new platform for hosting banned content: Minecraft.
The organization, collaborating with reporters, Minecraft pros and, of course, a creative agency, has produced an enormous in-game “Uncensored Library” that hosts a variety of suppressed reportage from places like like Saudi Arabia, Russia and Vietnam.
The structure is a giant neo-classical complex hosted on its own server, which Minecraft players can access freely by pointing their game toward “visit.uncensoredlibrary.com” in the server browser.
The library has a handful of wings, each dedicated to a different country, and each with a series of articles banned in those places, or their authors chased out or even killed. They’re presented in plain text inside Minecraft’s craftable books — not exactly the easiest way to take in these important essays and reports, but better than nothing.

There are documents from Nguyen Van Dai in Vietnam, Mada Masr in Egypt, Javier Valdez in Mexico, Alexander Skobov in Russia and arguably the most high-profile casualty to murderous, oppressive regimes in recent history, Jamal Khashoggi in Saudi Arabia. There are only a handful of recent articles at present, but there are also numerous documents describing the state of press freedom and oppression in 180 countries — the RSF Freedom Index.
Of course, this is not secure and private like an end-to-end encrypted chat group. A user accessing the library map might have their nickname, tied to a Minecraft account, be visible to other users, and their logs would reflect the visit. It seems unlikely Microsoft would give up that information to a curious government, but there is a certain risk involved. Fortunately, private duplicate servers can be and are already being established, as well as local copies.
As it stands, the Uncensored Library stands more as a proof of concept that information need not be delivered by traditional means in order to have a potential impact. Minecraft is one of the most popular games in the world, and can be used as an informational and promotional platform as well as just a fun place to hang out and build stuff. What other ways exist to get around the restrictions of governments that would rather their citizens not know the truth?

The FCC is finally going to require wireless carriers to implement an anti-robocalling technology, after asking them nicely for more than a year to do so at their convenience. Of course, the FCC itself is now required to do this after Congress got tired of waiting on them and took action itself.
The technology is called Secure Telephony Identity Revisited / Secure Handling of Asserted information using toKENs, mercifully abbreviated to STIR/SHAKEN, and amounts to a sort of certificate authority for calls that prevents phone numbers from being spoofed. (This is a good technical breakdown if you’re curious.)
STIR/SHAKEN has been talked about for quite some time as a major part of the fight against robocalls, and in 2018 FCC Chairman Ajit Pai said that carriers would have until the end of 2019 to implement it. 2019 came and went, and while the FCC (and indeed carriers) took other actions against robocallers, STIR/SHAKEN went largely undeployed.
Meanwhile, Congress, perhaps tired of receiving scam calls themselves, managed to collectively reach across the aisle and pass the TRACED Act, which essentially empowers the FCC and other departments to take action against robocallers — and prevents carriers from charging for anti-robocall services.
It also ordered the FCC to set a timeline for STIR/SHAKEN implementation, which is what Pai is doing now.
“It’s clear that FCC action is needed to spur across-the-board deployment of this important technology. There is no silver bullet when it comes to eradicating robocalls, but this is a critical shot at the target,” he said in a statement issued today.
There does not, however, appear to be any great hurry. The proposal, which will be voted on at the FCC’s meeting later this month, would require voice service providers to implement STIR/SHAKEN by June 30… of 2021. And one-year extensions will be available to smaller providers who claim difficulty getting the system up and running.
In other words, you can expect to keep receiving strange calls offering discounts on cruises and warning you of IRS penalties for some time to come. The FCC has officially and finally determined that the major wireless carriers in the U.S. broke the law by secretly selling subscribers’ location data for years with almost no constraints or disclosure. But its Commissioners decry the $208 million penalty proposed to be paid by these enormously rich corporations, calling it “not properly proportioned to the consumer harms suffered.”
Under the proposed fines, T-Mobile would pay $91M; AT&T, $57M; Verizon, $48M; and Sprint, $12M. (Disclosure: TechCrunch is owned by Verizon Media. This does not affect our coverage in the slightest.)
The case has stretched on for more than a year and a half after initial reports that private companies were accessing and selling real-time subscriber location data to anyone willing to pay. Such a blatant abuse of consumers’ privacy caused an immediate outcry, and carriers responded with apparent chagrin — but often failed to terminate or even evaluate these programs in a timely fashion. It turns out they were run with almost no oversight at all, with responsibility delegated to the third party companies to ensure compliance.
Meanwhile the FCC was called on to investigate the nature of these offenses, and spent more than a year doing so in near-total silence, with even its own Commissioners calling out the agency’s lack of communication on such a serious issue.
Finally, in January, FCC Chairman Ajit Pai — who, it really must be noted here, formerly worked for one of the main companies implicated, Securus — announced that the investigation had found the carriers had indeed violated federal law and would soon be punished.
Today brings the official documentation of the fines, as well as commentary from the Commission. In the documents, the carriers are described as not only doing something bad, but doing it poorly — and especially in T-Mobile’s case, continuing to do it well after they said they’d stop:
We find that T-Mobile apparently disclosed its customers’ location information, without their consent, to third parties who were not authorized to receive it. In addition, even after highly publicized incidents put the Company on notice that its safeguards for protecting customer location information were inadequate, T-Mobile apparently continued to sell access to its customers’ location information for the better part of a year without putting in place reasonable safeguards—leaving its customers’ data at unreasonable risk of unauthorized disclosure
The general feeling seems to be that while it’s commendable to recognize this violation and propose what could be considered substantial fines, the whole thing is, as Commissioner Rosenworcel put it, “a day late and a dollar short.”
The scale of the fines, they say, has little to do with the scale of the offenses — and that’s because the investigation did not adequately investigate or attempt to investigate the scale of those offenses. As Commissioner Starks writes in a lengthy statement:
After all these months of investigation, the Commission still has no idea how many consumers’ data was mishandled by each of the carriers.
We had the power—and, given the length of this investigation, the time—to compel disclosures that would help us understand the true scope of the harm done to consumers. Instead, the Notices calculate the forfeiture based on the number of contracts between the carriers and location aggregators, as well as the number of contracts between those aggregators and third-party location-based service providers. That is a poor and unnecessary proxy for the privacy harm caused by each carrier, each of which has tens of millions of customers that likely had their personal data abused.
Essentially, the FCC didn’t even look at the number or nature of actual harm — it just asked the carriers to provide the number of contracts entered into. As Starks points out, one such contract can and did sometimes represent thousands of individual privacy invasions.
We know there are many—perhaps millions—of additional victims, each with their own harms. Unfortunately, based on the investigation the FCC conducted, we don’t even know how many there were, and the penalties we propose today do not reflect that impact.
And why not go after the individual companies? Securus, Starks says, “behaved outrageously.” But they’re not being fined at all. Even if the FCC lacked the authority to do so, it could have handed off the case to Justice or local authorities that could determine whether these companies violated other laws.
As Rosenworcel notes in her own statement, the fines are also extraordinarily generous even beyond this minimal method of calculating harm:
The agency proposes a $40,000 fine for the violation of our rules—but only on the first day. For every day after that, it reduces to $2,500 per violation. The FCC heavily discounts the fines the carriers potentially owe under the law and disregards the scope of the problem. On top of that, the agency gives each carrier a thirty-day pass from this calculation. This thirty day “get-out-of-jail-free” card is plucked from thin air.
Given that this investigation took place over such a long period, it’s strange that it did not seek to hear from the public or subpoena further details from the companies facilitating the violations. Meanwhile the carriers sought to declare a huge proportion of their responses to the FCC’s questions confidential, including publicly available information, and the agency didn’t question these assertions until Starks and Rosenworcel intervened.
$200M sounds like a lot, but divided among several billion-dollar communications organizations it’s peanuts, especially when you consider that these location-selling agreements may have netted far more than that in the years they were active. Only the carriers know exactly how many times their subscribers’ privacy was violated, and how much money they made from that abuse. And because the investigation has ended without the authority over these matters asking about it, we likely never will know.
The proposed fines, called a Notice of Apparent Liability, are only a tentative finding, and the carriers have 30 days to respond or ask for an extension — the latter of which is the more likely. Once they respond (perhaps challenging the amount or something else) the FCC can take as long as it wants to come up with a final fine amount. And once that is issued, there is no requirement that the fine actually be collected — and the FCC has in fact declined to collect before once the heat died down, though not with a penalty of this scale.
“While I am glad the FCC is finally proposing fines for this egregious behavior, it represents little more than the cost of doing business for these carriers,” Congressman Frank Pallone (D-NJ) said in a statement. “Further, the Commission is still a long way from collecting these fines and holding the companies fully accountable.”
The only thing that led to this case being investigated at all was public attention, and apparently public attention is necessary to ensure the federal government follows through on its duties.

Much like private businesses, the United States government is in the process of moving workloads to the cloud, and facing a similar set of challenges. Today, CircleCI, the continuous delivery developer service, announced a partnership with AWS GovCloud to help federal government entities using AWS’s government platform to modernize their applications development workflows.
“What this means is that it allows us to run our server offering, which is our on-prem offering, and our government customers can run that on dedicated pure cloud resource [on AWS GovCloud],” CircleCI CEO Jim Rose told TechCrunch.
GovCloud is a dedicated, single tenant cloud platform that lets government entities build FedRAMP-compliant secure cloud solutions (other cloud vendors have similar offerings). FedRAMP is a set of government cloud security standards every cloud vendor has to meet to work with the federal government
CircleCI builds modern continuous delivery/continuous integration (CI/CD) pipelines for development teams pushing changes to the application in a rapid change cycle.
“What GovCloud allows us to do is now provide that same level of security and service for government customers that wanted us to do so in an on prem environment in a dedicated single tenant environment [in the cloud],” Rose explained.
While there are a number of steps involved in building cloud applications, Rose said they are sticking to their core strength around building continuous delivery pipelines. As he says, if you have a legacy mainframe application that changes once every year or two, using CircleCI wouldn’t make sense, but as you begin to modernize, that’s where his company could help.
“[CircleCi comes into play] when you get into more modern cloud applications that are changing in some cases hundreds of times a day, and the sources of change for those applications is getting really diverse and managing that is becoming more complex,” Rose said.
This partnership could involve working directly with an agency, as it has done with the Small Business Administration (SBA), or it might involve a systems integrator, or even AWS, inviting them to be part of a larger RFP.
Rose says he realizes that working with the government can sometimes be controversial. Companies from Chef to Salesforce to Google have run afoul with employees who don’t want to work with certain agencies like DoD or ICE. He says his company has tended to focus on areas where agencies are looking to improve citizen interactions and steered away from other areas.
“From our perspective, given that we’re not super involved in a lot of those areas, but we want to get in front of it, both commercially, as well as on the government side, and determine what falls within the fence line and what’s outside of it,” he said.

A sealed order from a judge today has halted the $10 billion, decade-long JEDI project in its tracks until AWS’s protest of the contract award to Microsoft can be heard by the court.
The order signed by Judge Patricia E. Campbell-Smith of the U.S. Court Federal Claims stated:
The United States, by and through the Department of Defense, its officers, agents, and employees, is hereby PRELIMINARILY ENJOINED from proceeding with contract activities under Contract No. HQ0034-20-D-0001, which was awarded under Solicitation No. HQ0034-18-R-0077, until further order of the court.
The judge was not taking this lightly, adding that Amazon would have to put up $42 million bond to cover costs should it prove that the motion was filed wrongfully. Given Amazon’s value as of today is $1.08 trillion, they can probably afford to put up the money, but they must provide it by February 20th, and the court gets to hold the funds until a final determination has been made.
At the end of last month, Amazon filed a motion to stop work on the project until the court could rule on its protest. It is worth noting that in protests of this sort, it is not unusual to stop work until a final decision on the award can be made.
This is all part of an ongoing drama that has gone on for a couple of years since the DoD put this out to bid. After much wrangling, the DoD awarded the contract to Microsoft at the end of October. Amazon filed suit in November, claiming that the president had unduly influenced the process.
As we reported in December, at a press conference at AWS re:Invent, the cloud arm’s annual customer conference, AWS CEO Andy Jassy made clear the company thought the president had unfairly influenced the procurement process:
“I would say is that it’s fairly obvious that we feel pretty strongly that it was not adjudicated fairly,” he said. He added, “I think that we ended up with a situation where there was political interference. When you have a sitting president, who has shared openly his disdain for a company, and the leader of that company, it makes it really difficult for government agencies, including the DoD, to make objective decisions without fear of reprisal.”
Earlier this week, the company filed paperwork to depose the president and Secretary of Defense Mark Esper.

Undisclosed influencer marketing posts on social media should trigger financial penalties, according to a statement released today by the Federal Trade Commission’s Rohit Chopra. The FTC has voted 5-0 to approve a Federal Register notice calling for public comments on questions related to whether The Endorsement Guides for advertising need to be updated.
“When companies launder advertising by paying an influencer to pretend that their endorsement or review is untainted by a financial relationship, this is illegal payola,” Chopra writes. “The FTC will need to determine whether to create new requirements for social media platforms and advertisers and whether to activate civil penalty liability.”
Currently the non-binding Endorsement Guides stipulate that “when there is a connection between an endorser and a seller of an advertised product that could affect the weight or credibility of the endorsement, the connection must be clearly and conspicuously disclosed.” In the case of social media, that means creators need to note their post is part of an “ad,” “sponsored” content or “paid partnership.”
But Chopra wants the FTC to consider making those rules official by “Codifying elements of the existing endorsement guides into formal rules so that violators can be liable for civil penalties under Section 5(m)(1)(A) and liable for damages under Section 19.” He cites weak enforcement to date, noting that in the case of department store Lord & Taylor not insisting 50 paid influencers specify their posts were sponsored, “the Commission settled the matter for no customer refunds, no forfeiture of ill-gotten gains, no notice to consumers, no deletion of wrongfully obtained personal data, and no findings or admission of liability.”

Strangely, Chopra fixates on Instagram’s Branded Content Ads that let marketers pay to turn posts by influencers tagging brands into ads. However, these ads include a clear “Sponsored. Paid partnership with [brand]” and seem to meet all necessary disclosure requirements. He also mentions concerns about sponcon on YouTube and TikTok.
Additional targets of the FTC’s review will be use of fake or incentivized reviews. It’s seeking public comment on whether free or discounted products influence reviews and should require disclosure, how to handle affiliate links and whether warnings should be posted by advertisers or review sites about incentivized reviews. It also wants to know about how influencer marketing affects and is understood by children.
Chopra wisely suggests the FTC focus on the platforms and advertisers that are earning tons of money from potentially undisclosed influencer marketing, rather than the smaller influencers themselves who might not be as well versed in the law and are just trying to hustle. “When individual influencers are able to post about their interests to earn extra money on the side, this is not a cause for major concern,” he writes, but “when we do not hold lawbreaking companies accountable, this harms every honest business looking to compete fairly.”

While many of the social media platforms have moved to self-police with rules about revealing paid partnerships, there remain gray areas around incentives like free clothes or discount rates. Codifying what constitutes incentivized endorsement, formally demanding social media platforms to implement policies and features for disclosure and making influencer marketing contracts state that participation must be disclosed would all be sensible updates.
Society has enough trouble with misinformation on the internet, from trolls to election meddlers. They should at least be able to trust that if someone says they love their new jacket, they didn’t secretly get paid for it.

Student loan debt in the U.S. totals $1.5 trillion, and more than 44 million Americans have outstanding student loan debt.
According to research by Villanova law professor Jason Iuliano, a million student loan debtors have filed for bankruptcy in the past five years. However, 99.9% of them did not include their student loan debt in their bankruptcy filing.
This research was the seed of what would become Reset Button, a new startup founded by Iuliano and Rob Hunter looking to help student loan debtors who have gone through bankruptcy find a new way to include those debts in their filing.
The only way you can include student loan debt in a bankruptcy filing is through litigation. Those cases have been historically less likely to settle out of court than other types of civil cases.
This means that the cost of including student loan debt in bankruptcy filings is, at the very least, around $10,000. Now, if there was some guarantee that you could trade hundreds of thousands of dollars of student loan debt for $10,000-$15,000, you’d obviously do it. But most folks who are already in the process of filing for bankruptcy don’t have a spare $10,000 minimum to spend on a litigator. And even if they did, there is no guarantee they’d win in court, resulting in even more debt and no relief.
This is what Reset Button is trying to change.
To be clear, Reset Button is targeted directly at folks who have already filed for bankruptcy but were told they couldn’t include their student loan debt in those filings, and so they didn’t.
Here’s how it works:
Reset Button has built a network of litigation lawyers who have experience in seeking student loan discharges. When a new user fires up Reset Button, the startup sends them through an evaluation process that collects financial information, etc. to assess whether or not one of those lawyers could litigate the discharge of that user’s student loan debt. That evaluation factors in a number of signals, including past legal cases that are comparable to the user’s situation.
That process also does a lot of the heavy lifting that makes hiring a litigator so expensive. These lawyers often have to do tons of research, tracking down statements and bills and other paperwork, before they can truly get started with the litigation.
Reset Button, as the connective tissue between debtor and lawyer, is able to automate a lot of that process for the lawyers, delivering a package of information on the case and connecting the user with the right lawyer for them.
Reset is also looking to bring down the cost for debtors. The company charges either 12% of the total debt discharged, or $10,000 (whichever is lowest). Reset also allows users to pay that sum over time, in $300 monthly installments. This is in stark contrast to people who hire their own lawyer, who would be responsible for the costs upfront.

Reset Button is able to do this through a payment process called factoring. In short, Reset buys the receivables from the attorney’s fees, and charges the debtor with their own payment plan. Reset makes money from lawyers who pay for the lead generation, the technology services and the marketing apparatus.
Factoring has come under fire from some who say that service providers sometimes raise prices to account for their fee, but Reset Button co-founders Hunter and Iuliano say their lawyers are actually charging less because of the workflow optimization provided by Reset Button.
The company also provides a Knowledge Base for debtors seeking financial guidance and resources, but the only revenue stream comes from the actual litigation of student loan debt in bankruptcy filings. Other services like refinancing, debt consolidation or income-based payments are not provided by Reset Button, and the company has no official partnerships with those types of service providers.
However, Hunter said that it may be an avenue the company explores as it grows.
Perhaps most importantly, Reset Button offers a Fresh Start guarantee. In short, if the lawyer doesn’t manage to get your debt wiped, Reset will pay your legal bills.
There has been movement in the landscape of student loan discharges with bankruptcy.
Essentially, debtors must prove in court that they pass the test of “undue hardship,” which is a notably vague framework. Though there is a bit of variability among the various court circuits, the general idea is that a debtor must prove that they can’t currently pay back the loan, that there will not be a change down the line that will allow them to pay the loan in the future and that they have made every effort to pay the loans in the past.
Historically, that’s been a difficult threshold to cross for the fraction of people who take steps to litigate their student loan debt. However, in small ways, courts seem to be opening up the interpretation of undue hardship.
“There’s a phrase that gets used in these cases that I think perpetuates this myth, and that is to call it a ‘certainty of hopelessness’,” said John Rao, attorney with the National Consumer Law Center. “And it’s almost like, as long as you’re still alive and breathing, something could improve for you. That’s just an impossible burden. It’s basically saying you could win the lottery or something. That’s just not the standard I think Congress had in mind.”
In 2015, in a case between Robert E. Murphy and the DOE/ECMC, Rao wrote to the courts arguing that they should reassess the test for undue hardship:
Rather than adopt one existing test over another, we urge this Court to provide a formulation of the undue hardship standard in simple terms, that restricts consideration of extraneous and inappropriate factors not consistent with the statutory language. A finding about whether a debtor’s hardship is likely to persist should be based on hard facts, not conjecture and unsubstantiated optimism.
More recently, a judge in the Southern District of New York ruled in favor of a debtor, wiping more than $200,000 in Kevin Rosenberg’s student debt. Of course, the lenders will be appealing the case.
However, Judge Morris, who presided over the case, wrote in her decision that “most people (bankruptcy professionals as well as lay individuals) believe it impossible to discharge student loans,” and that her “Court will not participate in perpetuating these myths.”
Reset Button has raised money from investors Craft Ventures, Slow Ventures and Jeff Morris Jr. of Lambda School, among others. The company declined to share its total amount of investment.
“Society has been led to believe something for decades that is not true, which is probably the biggest initial challenge,” said founder and CEO Rob Hunter . “One of the unfortunate things is the reason that many consumers believe incorrect information is because a lawyer told them that. So, that is a bit of an uphill battle to swim against.”
