Google is today announcing a series of policy changes aimed at eliminating untrustworthy apps from its Android app marketplace, the Google Play store. The changes are meant to give users more control over how their data is used, tighten subscription policies and help prevent deceptive apps and media — including those involving deepfakes — from becoming available on the Google Play Store.
Background Location
The first of these new policies is focused on the location tracking permissions requested by some apps.
Overuse of location tracking has been an area Google has struggled to rein in. In Android 10, users were able to restrict apps’ access to location while the app was in use, similar to what’s been available on iOS. With the debut of Android 11, Google decided to give users even more control with the new ability to grant a temporary “one-time” permission to sensitive data, like location.
In February, Google said it would also soon require developers to get user permission before accessing background location data, after noting that many apps were asking for unnecessary user data. The company found that a number of these apps would have been able to provide the same experience to users if they only accessed location while the app was in use — there was no advantage to running the app in the background.
Of course, there’s an advantage for developers who are collecting location data. This sort of data can be sold to third-party through trackers that supply advertisers with detailed information about the app’s users, earning the developer additional income.
The new change to Google Play policies now requires that developers get approval to access background location in their apps.
But Google is giving developers time to comply. It says no action will be taken for new apps until August 2020 or on existing apps until November 2020.
“Fleeceware”
A second policy is focused on subscription-based apps. Subscriptions have become a booming business industry-wide. They’re often a better way for apps to generate revenue as opposed to other monetization methods — like paid downloads, ads or in-app purchases.
However, many subscription apps are duping users into paying by not making it easy or obvious how to dismiss a subscription offer in order to use the free parts of an app, or not being clear about subscription terms or the length of free trials, among other things.
The new Google Play policy says developers will need to be explicit about their subscription terms, trials and offers, by telling users the following:
That means the “fine print” has to be included on the offer’s page, and developers shouldn’t use sneaky tricks like lighter font to hide the important bits, either.

This change aims to address the rampant problem with “fleeceware” across the Google Play store. Multiple studies have shown subscription apps have gotten out of control. In fact, one study from January stated that over 600 million Android users had installed “fleeceware” apps from the Play Store. To be fair, the problem is not limited to Android. The iOS App Store was recently found to have an issue, too, with more than 3.5 million users having installed “fleeceware.”
Developers have until June 16, 2020 to come into compliance with this policy, Google says.
Deepfakes
The final update has to do with the Play Store’s “Deceptive Behavior” policy.
This wasn’t detailed in Google’s official announcements about the new policies, but Google tells us it’s also rolling out updated rules around deceptive content and apps.
Before, Google’s policy was used to restrict apps that tried to deceive users — like apps claiming a functionally impossible task, those that lied in their listing about their content or features or those that mimicked the Android OS, among others.
The updated policy is meant to better ensure all apps are clear about their behavior once they’re downloaded. In particular, it’s meant to prevent any manipulated content (aka “deepfakes”) from being available on the Play Store.
Google tells us this policy change won’t impact apps that allow users to make deepfakes that are “for fun” — like those that allow users to swap their face onto GIFs, for example. These will fall under an exception to the rule, which allows deepfakes that are “obvious satire or parody.”
However, it will take aim at apps that manipulate and alter media in a way that isn’t conventionally obvious or acceptable.
For example:
In particular, the policy will focus on apps that promote misleading imagery that could cause harm related to politics, social issues or sensitive events. The apps must also disclose or watermark the altered media if it isn’t clear the media has been altered.
Similar bans on manipulated media have been enacted across social media platforms, including Facebook, Twitter and WeChat. Apple’s App Store Developer Guidelines don’t specifically reference “deepfakes” by name, however, though it bans apps with false or defamatory information, outside of satire and humor.
Google says the apps currently available on Google Play have 30 days to comply with this change.
In Google’s announcement, the company said it understood these were difficult times for people, which is why it’s taken steps to minimize the short-term impact of these changes. In other words, it doesn’t sound like the policy changes will soon result in any mass banning or big Play Store clean-out — rather, they’re meant to set the stage for better policing of the store in the future.

TikTok parent company ByteDance has built technology to let you insert your face into videos starring someone else. TechCrunch has learned that ByteDance has developed an unreleased feature using life-like deepfakes technology that the app’s code refers to as Face Swap. Code in both TikTok and its Chinese sister app Douyin asks users to take a multi-angle biometric scan of their face, then choose from a selection of videos they want to add their face to and share.

The deepfakes feature, if launched in Douyin and TikTok, could create a more controlled environment where face swapping technology plus a limited selection of source videos can be used for fun instead of spreading misinformation. It might also raise awareness of the technology so more people are aware that they shouldn’t believe everything they see online. But it’s also likely to heighten fears about what ByteDance could do with such sensitive biometric data — similar to what’s used to set up Face ID on iPhones.
Several other tech companies have recently tried to consumerize watered-down versions of deepfakes. The app Morphin lets you overlay a computerized rendering of your face on actors in GIFs. Snapchat offered a FaceSwap option for years that would switch the visages of two people in frame, or replace one on camera with one from your camera roll, and there are standalone apps that do that too, like Face Swap Live. Then last month, TechCrunch spotted Snapchat’s new Cameos for inserting a real selfie into video clips it provides, though the results aren’t meant to look confusingly realistic.
Most problematic has been Chinese deepfakes app Zao, which uses artificial intelligence to blend one person’s face into another’s body as they move and synchronize their expressions. Zao went viral in September despite privacy and security concerns about how users’ facial scans might be abused. Zao was previously blocked by China’s WeChat for presenting “security risks.” [Correction: While “Zao” is mentioned in the discovered code, it refers to the general concept rather than a partnership between ByteDance and Zao.]
But ByteDance could bring convincingly life-like deepfakes to TikTok and Douyin, two of the world’s most popular apps with over 1.5 billion downloads.

TechCrunch received a tip about the news from Israeli in-app market research startup Watchful.ai. The company had discovered code for the deepfakes feature in the latest version of TikTok and Douyin’s Android apps. Watchful.ai was able to activate the code in Douyin to generate screenshots of the feature, though it’s not currently available to the public.
First, users scan their face into TikTok. This also serves as an identity check to make sure you’re only submitting your own face so you can’t make unconsented deepfakes of anyone else using an existing photo or a single shot of their face. By asking you to blink, nod and open and close your mouth while in focus and proper lighting, Douyin can ensure you’re a live human and create a manipulable scan of your face that it can stretch and move to express different emotions or fill different scenes.

You’ll then be able to pick from videos ByteDance claims to have the rights to use, and it will replace with your own the face of whomever is in the clip. You can then share or download the deepfake video, though it will include an overlayed watermark the company claims will help distinguish the content as not being real. I received confidential access to videos made by Watchful using the feature, and the face swapping is quite seamless. The motion tracking, expressions and color blending all look very convincing.
Watchful also discovered unpublished updates to TikTok and Douyin’s terms of service that cover privacy and usage of the deepfakes feature. Inside the U.S. version of TikTok’s Android app, English text in the code explains the feature and some of its terms of use:

Make sure you’ve read and agree to the Terms of Use and Privacy Policy before continuing. 1. All video elements related to this feature provided by Douyin have acquired copyright authorization.

A longer terms of use and privacy policy was also found in Chinese within Douyin. Translated into English, some highlights from the text include:
“The ‘face-changing’ effect presented by this function is a fictional image generated by the superimposition of our photos based on your photos. In order to show that the original work has been modified and the video generated using this function is not a real video, we will mark the video generated using this function. Do not erase the mark in any way.”
“The information collected during the aforementioned detection process and using your photos to generate face-changing videos is only used for live detection and matching during face-changing. It will not be used for other purposes . . . And matches are deleted immediately and your facial features are not stored.”
“When you use this function, you can only use the materials provided by us, you cannot upload the materials yourself. The materials we provide have been authorized by the copyright owner”.
“According to the ‘Children’s Internet Personal Information Protection Regulations’ and the relevant provisions of laws and regulations, in order to protect the personal information of children / youths, this function restricts the use of minors”.
We reached out to TikTok and Douyin for comment regarding the deepfakes feature, when it might launch, how the privacy of biometric scans are protected and the age limit. However, TikTok declined to answer those questions. Instead, a spokesperson insisted that “after checking with the teams I can confirm this is definitely not a function in TikTok, nor do we have any intention of introducing it. I think what you may be looking at is something slated for Douyin – your email includes screenshots that would be from Douyin, and a privacy policy that mentions Douyin. That said, we don’t work on Douyin here at TikTok.” They later told TechCrunch that “The inactive code fragments are being removed to eliminate any confusion,” which implicitly confirms that Face Swap code was found in TikTok.
A Douyin spokesperson tells TechCrunch “Douyin follows the laws and regulations of the jurisdictions in which it operates, which is China.” They denied that the Face Swap terms of service appear in TikTok despite TechCrunch reviewing code from the app showing those terms of service and the feature’s functionality.

This is suspicious, and doesn’t explain why code for the deepfakes feature and special terms of service in English for the feature appear in TikTok, and not just Douyin, where the app can already be activated and a longer terms of service was spotted. TikTok’s U.S. entity has previously denied complying with censorship requests from the Chinese government in contradiction to sources who told The Washington Post that TikTok did censor some political and sexual content at China’s behest.
It’s possible that the deepfakes Face Swap feature never officially launches in China or the U.S. But it’s fully functional, even if unreleased, and demonstrates ByteDance’s willingness to embrace the controversial technology despite its reputation for misinformation and non-consensual pornography. At least it’s restricting the use of the feature by minors, only letting you face-swap yourself, and preventing users from uploading their own source videos. That avoids it being used to create dangerous misinformational videos like the slowed down one making House Speaker Nancy Pelosi seem drunk, or clips of people saying things as if they were President Trump.
“It’s very rare to see a major social networking app restrict a new, advanced feature to their users 18 and over only,” Watchful.ai co-founder and CEO Itay Kahana tells TechCrunch. “These deepfake apps might seem like fun on the surface, but they should not be allowed to become trojan horses, compromising IP rights and personal data, especially personal data from minors who are overwhelmingly the heaviest users of TikTok to date.”
TikTok has already been banned by the U.S. Navy and ByteDance’s acquisition and merger of Musical.ly into TikTok is under investigation by the Committee on Foreign Investment in The United States. Deepfake fears could further heighten scrutiny.
With the proper safeguards, though, face-changing technology could usher in a new era of user-generated content where the creator is always at the center of the action. It’s all part of a new trend of personalized media that could be big in 2020. Social media has evolved from selfies to Bitmoji to Animoji to Cameos, and now consumerized deepfakes. When there are infinite apps and videos and notifications to distract us, making us the star could be the best way to hold our attention.

The UK government has announced the next phase of a review of the law around the making and sharing of non-consensual intimate images, with ministers saying they want to ensure it keeps pace with evolving digital tech trends.
The review is being initiated in response to concerns that abusive and offensive communications are on the rise, as a result of it becoming easier to create and distribute sexual images of people online without their permission.
Among the issues the Law Commission will consider are so-called ‘revenge porn’, where intimate images of a person are shared without their consent; deepfaked porn, which refers to superimposing a real photograph of a person’s face onto a pornographic image or video without their consent; and cyber flashing, the unpleasant practice of sending unsolicited sexual images to a person’s phone by exploiting technologies such as Bluetooth that allow for proximity-based file sharing.
On the latter practice, the screengrab below is of one of two unsolicited messages I received as pop-ups on my phone in the space of a few seconds while waiting at a UK airport gate — and before I’d had a chance to locate the iOS master setting that actually nixes Bluetooth.
On iOS, even without accepting the AirDrop the cyberflasher is still able to send an unsolicited placeholder image with their request.
Safe to say, this example is at the tamer end of what tends to be involved. More often it’s actual dick pics fired at people’s phones, not a parrot-friendly silicone substitute…

A patchwork of UK laws already covers at least some of the offensive and abusive communications in question, such as the offence of voyeurism under the Sexual Offences Act 2003, which criminalises certain non-consensual photography taken for sexual gratification — and carries a two-year maximum prison sentence (with the possibility that a perpetrator may be required to be listed on the sexual offender register); while revenge porn was made a criminal offence under section 33 of the Criminal Justice and Courts Act 2015.
But the government says that while it feels the law in this area is “robust”, it is keen not to be seen as complacent — hence continuing to keep it under review.
It will also hold a public consultation to help assess whether changes in the law are required.
The Law Commission published Phase 1 of their review of Abusive and Offensive Online Communications on November 1 last year — a scoping report setting out the current criminal law which applies.
The second phase, announced today, will consider the non-consensual taking and sharing of intimate images specifically — and look at possible recommendations for reform. Though it will not report for two years so any changes to the law are likely to take several years to make it onto the statute books.
Among specific issues the Law Commission will consider is whether anonymity should automatically be granted to victims of revenge porn.
Commenting in a statement, justice minister Paul Maynard said: “No one should have to suffer the immense distress of having intimate images taken or shared without consent. We are acting to make sure our laws keep pace with emerging technology and trends in these disturbing and humiliating crimes.”
Maynard added that the review builds on recent changes to toughen UK laws around revenge porn and to outlaw ‘upskirting’ in English law; aka the degrading practice of taking intimate photographs of others without consent.
“Too many young people are falling victim to co-ordinated abuse online or the trauma of having their private sexual images shared. That’s not the online world I want our children to grow up in,” added the secretary of state for digital issues, Jeremy Wright, in another supporting statement.
“We’ve already set out world-leading plans to put a new duty of care on online platforms towards their users, overseen by an independent regulator with teeth. This Review will ensure that the current law is fit for purpose as we deliver our commitment to make the UK the safest place to be online.”
The Law Commission review will begin on July 1, 2019 and report back to the government in summer 2021.

While it might look like just a toy, investors see real business potential. Morphin raised $1 million last summer from Betaworks, the incubator that spawned Giphy, plus Founders Fund, Precursor, Shrug Capital and Boost.vc’s accelerator.

“We believe in the future you’ll be able to be the main character in your own film. Imagine a super hero movie where you’re the main protagonist?,” co-founder Loic Ledoux asks. “That sounded like science fiction a few years ago and now with AI and computer vision we definitely see our tech going there.”
Ledoux also wants to reclaim faceswaps as something fun rather than a weapon for misinformation. “Deepfakes brought something pretty negative to computer vision. But it’s not all bad. It’s about how you use the tech to give people a new tool for self expressions and storytelling.” And since Morphin re-generates the whole clip from scratch with CGI animation, they look right at a glance, but clearly aren’t manipulated copies of the original video designed to fool anyone.

Morphin started three years ago with the intention to build personalized avatars for games and VR so you could be a FIFA soccer player or Skyrim knight. Ledoux had started a 3D printing company to explore opportunities in scanning and modeling when he saw a chance to connect your real and virtual faces. He teamed up with his co-founder Nicholas Heriveaux, who’d spent 13 years working on 3D tech while modding games like Grand Theft Auto to insert his avatar and assets.
What they quickly recognized was that “People were just reacting to themselves on the screen,” ignoring the gameplay, Ledoux recalls. “Being able to see yourself as a hero was the underlying sentiment, so we focused on video completely.” Recognizable GIFs became its preferred medium, as they combine familiarity and the ability to convey complex emotions with a template that’s easy to personalize so they stand out.

Morphin’s tech no longer requires 3D scanning hardware and it works with just a regular selfie. You just snap a headshot, select a GIF from its iOS or Android app’s library and a few seconds later you have a CGI version of yourself in the scene (with no watermark) that you can export and post. “We wanted it to be super straightforward because we wanted people to relate to the content,” Ledoux notes. Over 1 million scenes have been created by 50,000 beta users, and each time a celebrity shares one of the GIFs Morphin has been sending them for marketing, scores of their followers demand to know which app they were using.
Morphin’s nine-person French team will have to keep innovating to stay ahead of avatar-making competitors like the ubiquitous Snapchat Bitmoji, Genies, Moji Edit and Mirror AI. Facebook, Microsoft and Google all have launched or are building their own avatar creators. But these typically live as 2D stickers or 3D AR animations you overlay on the real world. By using GIFs as a canvas, Morphin takes the pressure off your visage looking perfect and instead emphasizes the message you’re trying to get across.
The challenge will be for Morphin to become a consistent part of people’s communication stack. It’s easy to imagine playing with it and posting a few GIFs. But iconic new GIFs don’t emerge each day and without a social network to stay for, Morphin is at risk of becoming merely a forgotten tool. The app might need TikTok-style challenges like submitting the best personalized GIF to match a prompt or a GIF browsing feed to keep people coming back.

Morphin isn’t racing to monetize yet, but sees a chance to sell longer premium video scenes à la carte or as an unlimited subscription. Ledoux eventually hopes to unlock new forms of storytelling beyond existing GIFs. There’s also a chance for Morphin to highlight sponsored clips from upcoming movies or TV shows. “In the long-term we’re more interested in the analogy of Lil Miquela and how people are interacting with digital characters,” Ledoux explains, citing a virtual pop star whose developer Brud recently raised at a $125 million valuation.
One of the most exciting things about Morphin is that it will allow people to take the spotlight no matter how they look. Often times certain races, genders and looks are unfairly excluded from starring in today’s most popular media. But Morphin could let the underrepresented take their rightful place as stars of the screen.

How can you be sure an image wasn’t Photoshopped? Make sure it was shot with Truepic. This startup makes a camera feature that shoots photos and adds a watermark URL leading to a copy of the image it saves, so viewers can compare them to ensure the version they’re seeing hasn’t been altered.
Now Truepic’s technology is getting its most important deployment yet as the way Reddit will verify that Ask Me Anything Q&As are being conducted live by the actual person advertised — oftentimes a celebrity.

But beyond its utility for verifying AMAs, dating profiles and peer-to-peer e-commerce listings, Truepic is tackling its biggest challenge yet: identifying artificial intelligence-generated Deepfakes. These are where AI convincingly replaces the face of a person in a video with someone else’s. Right now the technology is being used to create fake pornography combining an adult film star’s body with an innocent celebrity’s face without their consent. But the big concern is that it could be used to impersonate politicians and make them appear to say or do things they haven’t.
The need for ways to weed out Deepfakes has attracted a new $8 million round for Truepic. The cash comes from untraditional startup investors, including Dowling Capital Partners, former Thomson Financial (which become Reuters) CEO Jeffrey Parker, Harvard Business school professor William Sahlman and more. The Series A brings Truepic to $10.5 million in funding.
“We started Truepic long before manipulated images impacted democratic elections across the globe, digital evidence of atrocities and human rights abuses were regularly undermined, or online identities were fabricated to advance political agendas — but now we fully recognize its impact on society,” says Truepic founder and COO Craig Stack. “The world needs the Truepic technology to help right the wrongs that have been created by the abuse of digital imagery.”

Here’s how Truepic works:
For example, Reddit’s own Wiki recommends that AMA creators use the Truepic app to snap a photo of them holding a handwritten sign with their name and the date on it. “Truepic’s technology allows us to quickly and safely verify the identity and claims for some of our most eccentric guests,” says Reddit AMA moderator and Lynch LLP intellectual property attorney Brian Lynch. “Truepic is a perfect tool for the ever-evolving geography of privacy laws and social constructs across the internet.”

The abuses of image manipulation are evolving, too. Deepfakes could embarrass celebrities… or start a war. “We will be investing in offline image and video analysis and already have identified some subtle forensic techniques we can use to detect forgeries like deepfakes,” Truepic CEO Jeff McGregor tells me. “In particular, one can analyze hair, ears, reflectivity of eyes and other details that are nearly impossible to render true-to-life across the thousands of frames of a typical video. Identifying even a few frames that are fake is enough to declare a video fake.”
This will always be a cat and mouse game, but from newsrooms to video platforms, Truepic’s technology could keep content creators honest. The startup has also begun partnering with NGOs like the Syrian American Medical Society to help it deliver verified documentation of atrocities in the country’s conflict zone. The Human Rights Foundation also trained humanitarian leaders on how to use Truepic at the 2018 Freedom Forum in Oslo.

Throwing shade at Facebook, McGregor concludes that “The internet has quickly become a dumpster fire of disinformation. Fraudsters have taken full advantage of unsuspecting consumers and social platforms facilitate the swift spread of false narratives, leaving over 3.2 billion people on the internet to make self-determinations over what’s trustworthy vs. fake online… we intend to fix that by bringing a layer of trust back to the internet.”
